Position
Barrister specialising in commercial litigation and arbitration, including insurance and reinsurance, professional negligence (of accountants, the legal profession, insurance/reinsurance professionals, financial advisers and construction professionals), and general commercial disputes. Advisory work includes insurance notification issues (recent advice includes coverage issuer arising from the collapse of Lehmans (Hong Kong and England) and from the Irish banking crisis) and FSA regulation of the general insurance market. Recent cases include a number of insurance and reinsurance arbitrations (including disputes in relation to the Californian Wildfires of 2007); AMEC plc & Akzo Nobel v Excess Insurance [2010], representing AMEC and Akzo Nobel in the employers’ liability policy trigger litigation (pending appeal to the Supreme Court in late 2011); Tesco Stores v D A Constable & Others [2008], defending underwriters against appeal brought by Tesco to determine whether its public liability policy responded to liabilities arising out of the collapse of the ‘Tesco Tunnel’ at Gerrards Cross; Outokumpu Stainless Limited v AXA & Others (2007), defending underwriters in an action brought against insurers for losses arising from radioactive contamination and the disposal of radioactive materials from a Sheffield steel plant; Cable & Wireless and Pender Insurance v Willis (UK) Ltd & 16 others (2006), defending Willis Group in the Pender Insurance litigation; TAG v Winterthur & O’s (2005), acting for solicitors’ professional indemnity insurers; C v D (2005), commercial court arbitration application to determine succession to the liabilities of the former Yugoslavian state reinsurer; Zurich International (Bermuda) Ltd v X (2004), acting for Zurich International in Bermudian arbitration to determine liabilities under various reinsurance treaties; Eagle Star Insurance v Cresswell & Others (2004), construction of claims co-operation clause in reinsurance covers.
