Position

Specialises in technology and construction and commercial law and related professional negligence, insurance and European law. Current cases include appeal to Supreme Court in Aspect Contracts (Asbestos) Ltd v Higgins Construction PLC [2014] 1 WLR 1220 (CA) and [2013] BLR 417 (Akenhead J) (recoverability of monies paid under an adjudicator’s decision), the test case of Network Rail v Handy (TCC: recoverability of loss following road on rail incidents), Burlington Resources Ltd v Hydrocarbon Resources Ltd (Commercial Court: restraints on right to terminate gas infrastructure contract / abuse of dominant position), MIC et al v Garrison et al (Commercial Court: £56m alleged fraud and breach of contract claim arising out of management of a Property development), Donnelly v Savills (QB: liability of stock condition surveyors). Recent cases include: AXN v (i)Worboys (ii) Inceptum Insurance Company Ltd [2012] EWHC 1730 (QB: insurance coverage/EU), ZRE v Interserve [2012] EWHC 3205 (TCC) (implied terms and dispute resolution/jurisdiction clauses), Alexander & Law v Coveside 152 Con LR 163 (TCC: enforcement of adjudication decision and insolvency). Recent non-contentious work includes advising the Association of British Insurers on legislative changes.

Career

Called 1992; Middle Temple (Lord Justice Sachs scholarship and Queen Mother Scholarship); Inns of Court Studentship; non-stipendiary lectureship in Jurisprudence at Christ Church, Oxford; regular lecturer (Arbrix Conference 2012), (SCL 2012), LCLCBA Jonathan Brock QC Annual Memorial.
