Position

John has 15 years’ experience of both prosecution and defence work in criminal cases under the Health & Safety at Work, etc Act 1974; extensive experience of cases involving the following: the primary duties under the 1974 Act; prosecutions for contravening statutory regulations; the ‘reasonable practicability’ defence; risk assessment; the provision of training and information to employees and HSE ACOPs and Guidance Notes. Work undertaken includes pre-charge advice (s20 powers/interviews etc), advice on plea and the basis for any guilty plea and mitigation. John also has 20 years’ experience of all forms of personal injury litigation with particular emphasis on industrial and occupational disease work. Lung disease cases handled in recent months include fibrosing alveolitis from alleged exposure to oil mists; dental technician’s pneumoconiosis; occupational asthma from exposure to solvents; and c15 cases of asbestos-related lung disease. In addition upper limb cases, employee welfare and workplace violence cases including stress and bullying (NHS employee/housing officer/police AI officer/print worker assaulted by fellow employees/auditor) and violence from third parties (sheltered housing officer/nurse/mental health worker/robberies of shops). Accident work includes: defence work for major insurance companies in claims for catastrophic injuries; serious orthopaedic injuries; chronic pain and psychiatric injury (including somatoform disorders). Recent work includes claims arising out of the Ladbroke Grove rail disaster.
