Position
Barrister specialising in standard form and ad-hoc building, engineering and commercial contracts; defects in design and workmanship; contractual performance; loss and expense claims; foundation failures; mechanical and electrical works; process plant; railways and light rail systems; tree root nuisance; the professional negligence of architects, engineers and surveyors; PI, contract and buildings insurance; litigation (particularly in the Technology and Construction Court), arbitration, professional conduct tribunals, adjudication, mediation, and negotiated settlements. Cases include: Bonnell’s Electrical Contractors Ltd v London Underground Ltd [1995] CILL 1110; Ove Arup & Partners International Ltd and Anor v Mirant Asia-Pacific Construction (Hong Kong)) Ltd and Anor [2003] EWCA Civ 1729 (CA) and [2007] EWHC 918. Also practices as an arbitrator, adjudicator and mediator.
Career
Called in England and Wales 1989, Inner Temple; called to the Northern Ireland Bar in 1998; adjudicator (TECBAR accredited); mediator (accredited by ADR Group and the Academy of Experts); chartered civil and structural engineer; in private practice as a consulting engineer prior to being called to the Bar: specialist areas of work included design of building structures; investigations of buildings and bridges; and foundations in difficult ground conditions; Construction Law Handbook (author of section on ADR); contributor to ‘A Guide for Expert Witnesses and their Clients’, 2nd edition published by the Institution of Structural Engineers.
