Health and safety, NHS governance, consumer.

Position

Specialises in regulatory law, specifically in health and safety, NHS governance, consumer protection including food safety. He represents NHS trusts and companies, their directors and employers in the regulatory field. His health and safety experience includes fatalities arising from machinery, construction, chemical, explosives, quarrying and hospital activities. He has particular experience in Carbon Monoxide poisoning cases and has recently successfully defended a company charges under Section 3 of the Health and Safety At Work Act 1974 during a four month trial at The Old Bailey. He has experience of homicide cases in Crown Court trials and appeals against conviction and sentence in the Court of Appeal, He has conducted appeals against enforcement notices in Employment Tribunals. He regularly appears in Coroners’ Courts. His work in the NHS governance areas includes representing NHS Trusts in NHS Performers List cases in relation to doctors and dentists both at the Reference Committee and First Tier Tribunal stages as well as UPV Cuilte appeal.

Career

Prior to his call to the Bar, he was admitted to the Roll of Solicitors in 1978 and was the senior litigation partner at Hammonds, London office, with particular responsibility for defending companies, their directors and employees in health and safety prosecutions. Prior to that he was senior solicitor at ICI plc with primary responsibility for defending the company in health and safety, environment and consumer protection prosecutions and representing the company in employment tribunals. He led the team of lawyers advising the company on existing and proposed health and safety legislation and representing it in Industry and EC committees. Prior to that he was chief prosecutor at Bow Street Magistrates’ Court, which followed several years of prosecuting experience in Greater Manchester and South Yorkshire. He was called to the Bar in 1993.
