Position

Siân studied Veterinary Medicine at Cambridge University and practised before coming to the Bar in 1997.

Siân has extremely wide ranging experience of professional liability claims, including claims against lawyers, architects, engineers, insurance brokers, surveyors/valuers, accountants, financial advisers, planning consultants, land management and estate agents, and veterinary surgeons.

During the past year Siân has acted in:

  • The successful appeal by the valuers from the decision of Mr Justice Blair, which was the first trial of a Commercial Mortgage Backed Securities or ‘CMBS’ claim against valuers brought by the issuer SPV of securitised loan notes secured against the properties valued.
  • The next case of this type to come to trial concerns allegedly negligent valuations of properties in a portfolio of London office buildings valued at considerably over £1bn (White Tower).
  • Advice and re-drafted guidance for the Law Society concerning certification of new-build property by architects following Hunt v Optima.
  • The Right to Buy ‘case managed’ litigation concerning thousands of firms of solicitor, ultimately resulting in discontinuance by the Claimants at the start of trial.
  • A multi-party dispute construction dispute arising out of Birmingham’s Broadway Plaza, defending the project architect, DLG. There have been two significant reported decisions on costs, with trial in May 2016.
  • The defence of numerous claims brought by the joint liquidator of a group of linked bridge funding entities (Tiuta companies and the Connaught Income Fund Series) against a number of different valuers and solicitors, involving different instructing solicitors. As counsel instructed on a range of such claims by different parties Siân has played a key role in orchestrating a consistent and co-operative approach to these claims.
