Position
Personal injury: CV v CICAP [2011] - Claimant suffered psychiatric injury following sexual abuse as a child. Successfully appealed against the original award of £8,200, resulting in a tenfold increase in the award to over £83,000. See the case note, CV v CICAP, APIL PI Focus, Vol 21, Issue 10, p.30 (Dec 2011). Inquest: Inquest into the death of Martin Dunleavy [2011]. Represented the family in a five day jury inquest. The Deceased, who had no history of mental health illness, exhibited paranoid behaviour leading to his arrest. He was admitted to hospital and was found in a stairwell with fatal injuries. The verdict was accidental death. Human rights: Application no 32666/10 X, Y, Z v the United Kingdom [2010]. Led by Lizanne Gumbel QC, assisted in a human rights claim brought by a couple with learning difficulties and the husband's mother, where it is contended that the local authority was under a duty to prevent a breach of a person's rights under Article 3 and 8 where the couple were harassed and severely abused by a group of teenage youths. The case was concluded by way of friendly settlement. Inquiry: [2008-10] Junior counsel for the Treasury Solicitors in the public inquiry into the death of Baha Mousa, an Iraqi civilian who died in British military custody in September 2003.
