Position

Practises in criminal law, civil law and costs-only litigation. Criminal law: regularly instructed for the prosecution and defence in cases in the Magistrates and Crown Courts and is happy to accept instructions in all areas of criminal law in both the Magistrates and Crown Courts. Appears frequently in the Crown Court on behalf of the prosecution and defence in relation to appeals against conviction and sentence, and has extensive experience of cases involving breaches of community orders and suspended sentence orders. During second six months of pupillage gained experience prosecuting and defending trials in the Magistrates’ Court for a broad range of offences including burglary, theft, handling stolen goods, section 47 assault, section 39 assault, public order offences and road traffic matters. Has dealt with a number of cases involving special measures applications, bad character evidence, identification evidence and child witnesses. Recent Cases: R v UN (2012) (Kirklees Magistrates’ Court) – successful prosecution of a 16-year-old defendant charged with the technical abduction of a minor under section 2 of the Child Abduction Act; R v RH (2012) (Bradford Crown Court) – successful defence of a man of previous good character charged with handling stolen goods in relation to 50 bathroom scales that had been stolen in a burglary; R v DG (2012) (Leeds Magistrates’ Court) – defence of a man suffering from mental health difficulties, including anxiety and panic attacks while at court, charged with section 2 harassment against his former partner; R v SK, SB and RA (2013) (Bradford Magistrates’ Court) – successful defence of a youth jointly charged with two others with offences of affray and criminal damage, following allegations that a group of 20-30 school boys had thrown bricks and stones at school buses; R v MSH (2013) (Bradford Crown Court) – appeal against conviction and sentence on behalf of the appellant who was convicted in his absence of criminal damage, section 39 assault and theft from person found to have kicked and punched a car door belonging to the complainant, thereafter stealing his night’s earnings and assaulting him by stamping on his head. Civil law: drawing on his experience prior to joining Chambers, Abdul is regularly instructed in personal injury work. Has a busy practice drafting advices on quantum and pleadings in a variety of different cases. Costs-only litigation: specialises in the area of costs-only litigation. Excellent knowledge of the detailed assessment procedure and regularly instructed to represent clients at detailed assessment hearings. Recent cases: RA v FM (April2012) – receiving party’s claimed costs reduced from £44,800 to £25,750 at summary assessment; MC v CA (June 2012) – successful reduction of a bill claimed at £14,300 to £9,100 (receiving party ordered to pay the paying party’s costs of detailed assessment summarily assessed in the sum of £1,300); WS v CT (October 2012) – successful reduction of a bill claimed at £20,600 to £12,100 – receiving party ordered to pay the paying party’s costs of detailed assessment summarily assessed in the sum of £1,300; WT v LV (December 2012) – successful reduction of a bill claimed at £11,100 to £5,200 – receiving party ordered to pay the paying party’s costs of detailed assessment summarily assessed in the sum of £1,500.
