Position

Barrister specialising in commercial, public and European and competition law, instructed in the ECJ, the ECtHR, the High Court and in LCIA Arbitration. She spent much of 2009 and 2010 representing the MOD in the Baha Mousa Public Inquiry, also instructed by both the Nickel Institute and Etimine in parallel cases for a Reference to the ECJ Junior Counsel in Zagorski v Secretary of State for Business, concerning the licence of drugs used in executions in the US. Other important cases include: European Law – Case C-381/08P(R) Dow AgroSciences several appeals to ECJ; Bookmakers Afternoon Greyhound Services v Amalgamated Racing Ltd and others [2008] All ER (D) 73 (Aug) competition claim relating to media rights; Lonsdale v Howard & Hallam [2007] 4 All ER 1 intervening in the House of Lords, commercial agents regulations case; Barker v Department for Environment, Food and Rural Affairs (Ch Div 2007); Easyjet v Liverpool Airport on behalf of the defendants in competition law claim; Adidas v International Tennis Federation & ors on behalf of the defendants in competition law claim. Public and administrative law: R (Smith) v (1) Secretary of State for Justice & (2) Parole Board [2008] EWHC; Curran v HMRC; Eclipse v HMRC; Meredith v HMRC – for HMRC in applications by the taxpayer that enquiries be closed; Aehmed v Legal Services Commission [2009] EWCA Civ 572 – appeal against an order that a Labour Party-funded candidate have his costs of defending an election petition met by the LSC; R (Government of Bermuda) v Office of Communications [2008] All ER (D) 88 (Aug) – junior counsel for the Government of Bermuda; Mkombozi v Attorney General (High Court of Tanzania, 2008) – appeared in the High Court in Tanzania, in a direct constitutional challenge against the rounding up of street children; Lord Avebury v The Information Commissioner, successfully seeking the disclosure of the dates of meetings between Tony Blair and Rupert Murdoch or Richard Desmond; R (Royal Institution of Chartered Surveyors) v The Secretary of State for Communities and Local Government (settled 2007) -junior counsel for the Claimant in a judicial review on the consultation of home information packs; R (Dost Mohammed) v Secretary of State for Defence (Court of Appeal) [2007] All ER (D) 09 junior counsel for the Secretary of State defending a race discrimination challenge to the ex gratia Far Eastern Prisoner of War compensation scheme. Commercial Law: Arbitration under LCIA rules Aria Foods UK v Barnes and Others [2009] 1 B.C.L.C. 699; Royal Bank of Scotland v Winterthur, breach of share sale warranty claim; Associated British Ports v Ferryways and Another [2008] 2 Lloyd’s Rep 353 and (Court of Appeal) [2009] 1 Lloyd’s Rep. 595 relating to guarantees/indemnities; The Accident Group Litigation Junior counsel for Winterthur and NIG; Liverpool Football Club v Reebok for Reebok contractual dispute concerning replica shirts.
