Position

Scott Lyness specialises in all aspects of planning and environmental law. He acts for a wide range of private and public sector clients at all stages of the planning process. He provides strategic and technical advice on the preparation of development proposals and policy, along with representation at planning inquiries and in the Higher Courts.  His recent experience has comprised advising on, or appearing at major public inquiries into, city centre regeneration schemes (Paradise Street, Liverpool, Trinity Quarter, Leeds, Victoria Transport Interchange, Battersea Power Station and Earls Court, London); urban extensions (Polegate, East Sussex); retail (John Lewis, Sprucefield); and energy-related infrastructure development (Hinkley Point C, Tyrone Navan Interconnector). Many of his cases involve environmental law in areas including environmental impact assessment, strategic environmental assessment nature conservation, pollution control, waste management and contaminated land. He appeared in the leading case on the use of compulsory acquisition powers for planning purposes (R (on the application of Sainsbury’s Supermarkets Ltd v Wolverhampton City Council and Tesco Stores Limited [2010] UKSC 20). Publications of note: co-author, ‘Environmental Law’ (Oxford University Press).
