Position

Dan’s practice covers planning, environmental, rating, local government and public law. He frequently acts as an advocate in the High Court and Court of Appeal, at public inquiries and before the Upper Tribunal. His clients include central government, local government, developers, interest groups, ratepayers, individual claimants and NGOs. Notable recent cases include: Woolway (VO) v Mazars - Supreme Court case on the identification of the hereditament in the rating list; Monk v Newbegin (VO) - Supreme Court hearing (November 2016) - approach to rating valuation of property undergoing refurbishment; Broadview Energy v SSCLG - Court of Appeal case on the role of MP's in planning decisions; Aldergate Properties Ltd v Mansfield DC - successful judicial review on the sequential test for retail development; R (Nicholson) v Allderdale BC - challenge to noise condition for motor testing track; Arsenal Football Club Plc v SSCLG – represented Arsenal in High Court planning challenge); R. (on the application of Powell) v Brighton Marina Co Ltd – acted for Defendants to judicial review claim concerning the redevelopment of Brighton Marina. He advised the Airports Commission throughout its process (2013-2015).
