Heather practises primarily in planning, environmental, property and EU law. Recent planning work includes advising in respect of a proposed challenge in relation to development at London Luton Airport, appearing at a two day inquiry in relation to Southend Airport and appearing as junior counsel at inquiries relating to retail and housing development. Heather has also recently acted as junior counsel in a number of High Court judicial review and statutory challenges, including a challenge to the Mayor of London’s Revised Early Minor Alterations to the London Plan and challenges in the neighbouring planning, retail, solar power and waste contexts. Heather has a particular interest in EU environmental law, having gained significant experience in relation to the Habitats Directive whilst a trainee at the Court of Justice of the EU in 2012. Recent environmental work includes acting for the defendant in a prosecution pursuant to the Environmental Protection Act 1990, advising on the Climate Change Act 2008 and advising on costs in relation to an Aarhus Convention claim. Particular examples of recent property work include advising in relation to leasehold enfranchisement, advising in respect of restrictive covenants and related applications to the Upper Tribunal (Lands Chamber) and numerous matters in relation to mobile homes, including successfully acting for the defendants in a two day County Court trial. As regards EU law, in addition to EU environmental law Heather is particularly interested in EU State aid law and EU public procurement law and has recently advised in respect of the application of both to planning matters. She is currently acting pro bono for the claimant in proceedings before the Social Security and Child Support Tribunal concerning EU residence rights.
