Position
Regulatory crime, with particular focus on health and safety, environmental, DEFRA and planning prosecutions. Environmental: Nigel’s practice encompasses all aspects of environmental matters, including water and air pollution, spillage, waste licence breach, waste management and illegal export. In addition he undertakes work in the field of statutory nuisance and abatement notices. Examples include: R (EA) v RL and JF [2009] All ER 786, EWCA 1970 [2008] (successful defence of a golf club against offences under the Water Resources Act – a guideline case on the correct approach to the prosecution of unincorporated associations). Current (2011) cases include: R (EA) v D and G (defence of company directors against charges bought under the Environmental Protection Act 1990 and associated alleged permit and export offences connected to the alleged illegal storage and export of TV monitors); R (EA) v SG (defence of a company director over the alleged illegal storage and export of tyres to a non-OECD country); SGDC v S (defence of a large waste company charged with allowing waste to escape from their vehicles whilst transporting it to landfill). Health and safety: he is regularly instructed in cases involving all types of industrial practice, including accidents arising from machinery, quarries, agriculture, construction sites, retail outlets and boat yards. Examples: R v W [2010] (successful prosecution of a farmer who left mud on the road, causing the death of a passing motorist after he lost control due to the poor road surface); R v AD [2011] (defence of a food production company after an employee lost part of his limb in an unguarded machine). DEFRA: current cases include defence of a company and its managing director over allegations of supplying labour in contravention of the Gangmaster Licensing Act 2004. Crime: all aspects of criminal work, including rape, serious violence, blackmail, sexual assault and drug supply offences. Reported cases: R v RL and JF [2009] All ER 786, [2008] EWCA 1970, CLW 08/34/5, LS Gazette 18/0912008; R (Blouet) v Bath and Wansdyke Magistrates Court [2009] EWHC 759 (Admin); R v P [2006] EWCA Crim 1300.
