Types of work undertaken: D Young & Co offers a full range of IP management services, including IP generation (drafting, filing, prosecution and attending to grant of patents, trade marks, service marks and designs), IP utilisation, defence, enforcement and challenge (representing clients before the English Courts, UK Patent and Trade Mark Office, the European Patent Office and OHIM, coordinating pan-European litigation matters, and advice regarding procurement or licensing) and IP awareness (departmental reviews for clients, searching, monitoring and advising on third-party IP positions).

D Young & Co’s practice is divided between four main groups: the trade mark group has consistently been in the top five for UK filings in the last ten years and has a substantial CTM (Community Trade Mark) filing and prosecution practice, as well as handling over 1,500 CTM oppositions since the system commenced operation. The team advises on a diverse range of goods and services, including the fashion industry, rock and pop groups, food products, beverages and chemicals.

The electronics, engineering and IT group serves clients with business interests across a broad range of technical fields, including consumer and broadcast electronics, image and signal processing, telecommunications, information technology, physics, optical technology, computer processor architecture, automotive technologies, aerospace technologies, engineering structures, microengineering technologies and advanced materials, including ceramic, composite and electronic materials. The group also works in the field of registered designs and design right.

The biotechnology, chemistry and pharmaceuticals group is one of the most successful patent life sciences groups in Europe and provides a depth of experience across a broad range of technologies, including chemistry, biochemistry, pharmacology, biotechnology, molecular biology, immunology, food technology, polymer technology and electrochemistry. The group serves clients in the pharmaceutical, food, veterinary, agrochemical, polymer, cosmetics, petrochemical, lubricant additives and fuel cell industries. The group has particular expertise in contentious matters, including pan-European litigation, oppositions and appeals before the European Patent Office.

The dispute resolution and litigation group has extensive experience in all forms of IP enforcement and exploitation, both before the English Courts and in coordinating multi-national litigation. They cover all areas of IP as well as domain name disputes, copyright, technology disputes and advertising/marketing law issues. Particular areas of expertise include luxury goods, the fashion industry, FMCG, engineering/construction, pharmaceuticals, financial services and media/publishing.

    In Nzinga Maswaku v Westminster City Council [2012] EWCA Civ 669 the Court of Appeal clarified that in offering a homeless person with alternative temporary accommodation the local authority is obliged to point that if the offer is refused it has discharged its Part VII duties under the Housing Act 1996.

  • COUNCIL TAX

    In Harrow LBC v Ayiku [2012] EWHC 1200 (Admin) Sales J held that the word “or” in the Council Tax (Exempt Dwellings) Order 1992, art 3 Class N, had a disjunctive meaning, therefore it was sufficient for the non-British spouse of a foreign student to satisfy one or other of the two conditions, namely being prevented from taking paid employment or being prevented from claiming benefits, in order to qualify as a “relevant person” who was exempted from liability to pay council tax.

    In R (Calver) v Adjudication Panel for Wales [2012] EWHC 1172 (Admin) Mr Calver was a member of Manorbier Community Council who successfully challenged the decision of the Panel to dismiss his appeal against a decision by Prembrokeshire County Council Standards Committee censuring him for a number of comments or blogs posted by him on a website he owned and controlled.

  • Judicial Review

    The Judgment of Lindblom J in The Manydown Co Ltd v Basingstoke and Deane BC [2012] EWHC 977 (Admin) repays attention. The Claimant sought to challenge by judicial review 2 decisions of the Council: (1) the Council’s refusal to reconsider its position on the development of a site that it owns (and is the subject matter of a Joint Development Partnership Agreement with the Claimant); and (2) a decision of the Council’s Cabinet approving a selection of sites for development which did not include this site.
