Toby Barker has extensive experience in acting for lenders on a broad range of transactions including senior and mezzanine debt, development funding and tax-driven structures.

He has particular knowledge in cross-border work and has acted on transactions involving a number of different jurisdictions including Germany, Italy, Spain, Belgium, Holland, France, Hungary and China.

Whilst acting predominantly for lenders, Toby regularly undertakes work for borrowers and has experience in dealing with most types of property and sectors including healthcare, residential, student accommodation, hotel and leisure and commercial.

Highlights included UK group head Toby Barker acting for Aareal Bank on its financing of Henderson Park’s £500m acquisition of the London and Birmingham Hilton Metropole Hotels and assisting Barings Real Estate Advisers with the acquisition and development financing of the Landmark Manchester office space. Among the team’s cross-border work was Christopher Chan’s advice to an investment bank on the provision of a facility to assist with the acquisition and development of a student accommodation site in Belfast, and to a German financial institution in relation to an investment facility to refinance the acquisition of a portfolio of assets in Germany. Paul Gray is also a key member of the team. Laurence Rogers moved to McDermott Will & Emery UK LLP in April 2018.

  • Sentencing guidelines for corporate manslaughter

    In February 2010 the Sentencing Guidelines Council (the SGC) issued definitive guidelines to courts on imposing appropriate sentences for corporate manslaughter and health and safety offences causing death. The SGC states that fines imposed on companies found guilty of corporate manslaughter should not fall below £500,000, while fines in respect of health and safety offences that are a significant cause of death should be at least £100,000. Crucially, the SGC declined to provide for a fixed link between the imposed fine and the turnover or profitability of the offending company.‚Ä©
