Claus Holberg is especially engaged in tax law. Through his chairmanship of the Danish Lawyers’ Tax Law Association, he gained keen appreciation of tax policy developments. Within the area of tax law, he provides advice on the sale and purchase of enterprises, ownership transfer and restructuring and conducts litigation. Over the years, Claus Holberg has conducted a large number of legal proceedings within several legal areas and thereby gained major and profound experience in this respect. In addition, Claus provides general business advice and has experience of board duties. Over his career, he has been a member of several boards of directors of both small and medium-sized enterprises within the sectors of production, trade and particularly retail chains. Finally, Claus Holberg is an experienced advisor of public authorities and frequently provides advice to both the Danish State and Danish municipalities on issues relating to public law. Claus has conducted cases before the Supreme Court on behalf of eg PWC, the Municipality of Slagelse, LM Glasfibre A/S, Solar A/S, Danish local bank Egnsbank Hanherred and the Danish Defence Estates and Infrastructure Organisation. He has conducted large cases or cases of general public importance before the High Courts, the Maritime and Commercial Court and boards as well as commissions on behalf of eg the County of Copenhagen, Alm. Brand, Hamburg-Mannheimer, Metronom, Viasat and a number of Danish municipalities, including the Municipalities of Høje-Taastrup and Skælskør.

  • Sentencing guidelines for corporate manslaughter

    In February 2010 the Sentencing Guidelines Council (the SGC) issued definitive guidelines to courts on imposing appropriate sentences for corporate manslaughter and health and safety offences causing death. The SGC states that fines imposed on companies found guilty of corporate manslaughter should not fall below £500,000, while fines in respect of health and safety offences that are a significant cause of death should be at least £100,000. Crucially, the SGC declined to provide for a fixed link between the imposed fine and the turnover or profitability of the offending company.
