The firm

DLA Piper is one of the largest global legal services practices in the world, with over 4,200 lawyers in 76 offices in 30 countries. From its offices in Asia, Europe, the Middle East and the US, legal and business advisers provide a broad range of services to local, regional and international clients.

In the Netherlands, the services are tailored to the Dutch market, regardless of whether the client is Dutch or international. DLA Piper has more than 250 people in Amsterdam, including over 120 lawyers, civil law notaries and tax advisers. It always offers creative, to-the-point solutions and advice. It is practical, goal-oriented and careful to find the right balance between effort, costs and results. Its working methods are sensible but at the same time personal.

To extend its already substantial geographic presence, DLA Piper has an exclusive agreement with independent law firms in Africa, Australasia, Europe and the Middle East, collectively known as DLA Piper Group. Through the alliance, DLA Piper provides integrated international legal solutions for clients, wherever they chose to do business.

Areas of practice

The firm’s corporate lawyers handle all types of transactional and advisory matters in private equity, capital markets and M&A, as well as advising large- and medium-sized (listed and non-listed) companies and institutions on corporate governance, joint ventures, professional associations and (dis)investments.

The employment lawyers advise on the full range of employment issues. The group has a strong advice and litigation practice, focusing on a practical approach to often complex legal problems. The majority of the firm’s clients are major national and international companies that need advice on local employment matters.

The DLA Piper finance and projects team consists of experienced lawyers who act for both domestic and international financial institutions, providing a wide range of banking and finance services. Core specialities are leveraged and structured finance, asset-based finance and trade finance. The team, furthermore, focuses on prudential supervision issues and related transactions, including derivatives and securitisation work.

DLA Piper has been a leading law firm in the field of litigation and arbitration for many years. Its highly experienced corporate and commercial litigation specialists represent clients before the Dutch and European courts in national and international arbitration cases and they provide guidance to their clients in proceedings before foreign courts. The banking litigation team has specialists who represent and advise financial institutions in a wide range of disputes and conflicts in relation to a variety of financial issues, such as foreclosure activities, debt recovery, consumer complaints and claims in relation to asset management and advice.

The real estate group provides top-quality, multi-disciplinary services to corporate occupiers, developers, the public sector and rapidly changing industry areas such as construction, retail, hotel and leisure.

The restructuring lawyers work with the advisers and managers of underperforming companies and their investors. The Netherlands’ insolvency courts regularly appoint the firm’s lawyers as administrators in administration and as trustees in corporate bankruptcies.

DLA Piper’s tax lawyers deliver the highest quality professional advice and expertise to clients. They have experience with M&A work, corporate restructuring, wage taxes, tax litigation, VAT, customs, transfer pricing, and excise and anti-dumping duties, as well as tax and estate planning for wealthy individuals.

DLA Piper’s IP and technology lawyers provide contentious and non-contentious advice to clients in the areas of commercial, IT, telecommunications and IP.

  • Sentencing guidelines for corporate manslaughter

In February 2010 the Sentencing Guidelines Council (the SGC) issued definitive guidelines to courts on imposing appropriate sentences for corporate manslaughter and health and safety offences causing death. The SGC states that fines imposed on companies found guilty of corporate manslaughter should not fall below £500,000, while fines in respect of health and safety offences that are a significant cause of death should be at least £100,000. Crucially, the SGC declined to provide for a fixed link between the imposed fine and the turnover or profitability of the offending company.
