DLA Piper has a focus on IT and chemical sector deals, as well as expertise in matters relating to China and India. The group advised Rotem Amfert Negev on its acquisition of professional fertiliser business from Scotts, and Groupon on its takeover of German startup CityDeal. The practice lost Klaus von Gierke and his team, but still features several excellent practitioners including the ‘seasoned professional’ Christoph Papenheim and the ‘very hands-on’ Benjamin Parameswaran, and the team receives praise for its ‘willingness to go the extra mile’. Nils Krause joined from White & Case LLP.

Dispute resolution

Within Dispute resolution , tier 4

Hogan Lovells International LLP’s merger broadened its international client base, and allowed it to manage international litigation in a more ‘cost-effective, quick and very practical’ way. It represented PwC in a professional indemnity dispute with the Free State of Saxony regarding the collapse of the formerly state-owned bank Sachsen LB, and earned new clients such as Chartis Europe and the German Federal Cartel Authority, the latter of which was defended against a €1.1bn claim for damages. Practice head Detlef Hass is recommended along with Jürgen Witte, who ‘knows the industry very well’, and Ina Brock, who ‘gets things done’. Thomas Gädtke left with a team to join DLA Piper.

DLA Piper enjoys a good reputation for cross-border matters. It advised Cisco on a cost and workforce reduction exercise and acted for H&M in disputes between works councils and management. Volker von Alvensleben is recommended along with Rolf Kowanz, who remains ‘calm and confident in difficult negotiations’.

DLA Piper’s Julia Schönbohm has built a sizeable practice that recently received high-end instructions such as representing Osram against LG regarding LEDs, and Motorola in a multi-jurisdictional patent litigation. Benjamin Grzimek is well regarded.

DLA Piper enjoyed a busy year of growth, and played a prominent role in numerous cloud computing and outsourcing matters. Furthermore, clients especially appreciate the group’s ‘fantastic data protection expertise’. The team advised Preo Software on the distribution of used software and regarding certain litigation matters; a supplier of software security solutions on distribution matters; and Xing on a new online platform. Jan Pohle and Jan Geert Meents are highly regarded.

Maritime, shipping and transport

Carsten Grau is the key figure in DLA Piper’s practice, which recently advised a Chinese client regarding actions against a collapsed German shipping company, a matter where it was able to draw on international resources. Stiftung Hamburg Maritim and Samskip Group are also clients.

Public sector

DLA Piper can draw on a ‘fantastic’ European network of public law partners with the German team focusing on environmental, infrastructure and transport matters (particularly in aviation), where it has substantial regulatory expertise. The team advised BP on the duty to deliver oil products to Iranian airlines under German aviation and export controls, and advised Reverse Logistics on the regulatory regime for waste shipments. Litigation and regulatory group head Ludger Giesberts is ‘exceptionally good’.

  • Sentencing guidelines for corporate manslaughter

    In February 2010 the Sentencing Guidelines Council (the SGC) issued definitive guidelines to courts on imposing appropriate sentences for corporate manslaughter and health and safety offences causing death. The SGC states that fines imposed on companies found guilty of corporate manslaughter should not fall below £500,000, while fines in respect of health and safety offences that are a significant cause of death should be at least £100,000. Crucially, the SGC declined to provide for a fixed link between the imposed fine and the turnover or profitability of the offending company.
