Career

Michael H. McGinley focuses his practice on litigation, specifically appellate and complex commercial matters. Mr. McGinley has experience representing clients at every level of the federal judiciary, as well as in numerous federal agencies and state courts. He has litigated a wide range of issues, including federal jurisdiction, foreign sovereign immunity, Chevron deference, federalism, preemption, arbitration, labor law, tort law, securities and corporate law, contract rights, voting rights, free speech, religious freedom and many other constitutional issues.  Mr. McGinley also regularly advises individual, corporate and government clients on strategic and regulatory matters.

The group at Dechert LLP, which is chaired by Chicago-based David Kistenbroker and New York-based David Kelley, specializes in securities matters, as well as corporate governance and FCPA issues, congressional and internal investigations, US export controls and economic sanctions. Andrew Levander and Benjamin Rosenberg in New York are defending the director of a Hong Kong-based NGO, Dr Chi Ping Patrick Ho, in a criminal prosecution for alleged violations of the FCPA and money laundering charges relating to the bribery of Chadian and Senegalese government officials for the benefit of a Chinese energy company. Alongside Neil Steiner, Levander and a number of associated entities in multiple government agency investigations concerning the purchase of two not-for-profit nursing homes, which were promptly closed and sold to a luxury real estate developer, allegedly removing a deed restriction on the property; ultimately the client was cleared of any wrongdoing. Cathy Botticelli, Vincent Cohen are the names to note in Washington DC, and New York-based Jonathan Streeter is also recommended. In Philadelphia, the bench was greatly strengthened by the arrival of Michael McGinley, who joined the firm in April 2018 after serving as special assistant and associate counsel to President Trump.

In other notable moves, commercial litigator David Stern joined the Los Angeles office from Hughes Hubbard & Reed LLP, and Michael McGinley joined in Philadelphia after serving as associate counsel and special assistant to the President in the White House Counsel's Office. Star litigators at the firm include securities fraud litigation expert Linda Goldstein in New York, William Oxley, managing partner of the Los Angeles office, and Washington DC-based Christina Sarchio, who recently secured dismissals for Apple in class action cases that alleged violations of a New Jersey consumer protection statute. Matthew Larrabee heads the department from New York.

Dechert LLP is 'excellent' at handling complex multi-jurisdictional litigation matters, where it regularly advises investment funds, corporations and sovereign bodies. Indeed, the team is ‘brilliant, dedicated to its clients and is certainly a tier-one firm’, according to one client. Dennis H Hranitzky, who is co-head of the firm's international and insolvency litigation group in New York, is 'very sharp and very strategic’; he is currently advising funds managed by Argentem Creek Partners LP in litigation and Chapter 15 insolvency proceedings relating to defaulted bonds. Department co-head Gary Mennitt is also recommended.
