Corporate recovery and insolvency.

Position

Head of the firm’s corporate recovery and insolvency department. He has extensive experience of dealing with all types of corporate insolvency, both nationally and cross-border. Acts for all the major accountancy practices in respect of formal insolvency appointments, advising on finance, asset realisation, security issues and company disposals. Advises a range of stakeholders in respect of issues arising out of liquidation, administration or US Chapter 11-style procedures. Provides advice to corporate clients in respect of supply chain management and contract issues arising out of supplier default as a result of an insolvency process. Works with directors, interim managers and turnaround practitioners to provide restructuring and distressed situation advice, dealing with creditors, investors and lenders to secure long-term survival, or time to secure an accelerated sale. Has expertise in asset tracing and recovery, both nationally and internationally and in insolvency litigation, including wrongful trading and misfeasance actions and antecedent transaction litigation. He oversees the debt recovery team and has considerable experience in delivering a proactive debt recovery and advisory service for large multinationals, health authorities and corporate clients.

The recovery and insolvency department at DAC Beachcroft LLP has experience of recovery matters involving a wide-range of assets and is especially active in large, cross-border recoveries. In a recent example, the department acted for Sovereign Global on the arrest and recovery of a ship in Djibouti, and in a separate matter acted for Western Union Business Solutions UK in relation to the recovery of a debt from an international mining company. Practice head Giles Hindle acted for a US corporate in relation to the seizure of two planes, and also assisted a US law firm in the enforcement of a debt in England. Christopher Stoate is an active senior associate in the practice group and has particular expertise in cross-border insolvency restructuring and asset tracing and recovery. Other notable clients include Stellar Logistics, Post Office Limited and Wessex Eagle.

DAC Beachcroft LLP’s insolvency practice acts for lenders, corporates and insolvency practitioners, and has sector expertise in health, retail and manufacturing. Giles Hindle heads the practice group and is acting for new client Quantuma in its role as administrators regarding the sale of Specialist Engineering Systems Limited. Hindle is also instructed by clients such as Mazars, RSM Tenon and Stonham & Co, and has also been instructed by a local authority in relation to its exposure in a major development project. Kevin Hawthorn was promoted to partner in 2016 and specialises in asset tracing, recovery and insolvency litigation. Hawthorn is acting for Begbies Traynor as administrators in relation to the sale of Pink Planet Exchange Limited. Senior associate Christopher Stoate is another active member of the department and specialises in cross-border insolvency restructuring and transactions and asset tracing.
