Position

Sarah Clover is Chair of the Executive of Clyde & Co's UK Professional and Financial Disputes team. She has specialised in lawyers' professional liability for nearly 30 years and has been involved in some of the most high profile claims against law firms. She acts for both barristers and law firms in relation to sensitive professional negligence claims. Sarah is the first point of contact for a number of top City, national and US firms. Sarah also advises clients on regulatory issues and proceedings, risk management and policy coverage. Sarah has a wealth of experience in mediation and other forms of alternative dispute resolution. She is a well-known speaker and author on the subject of solicitors’ professional liability.

Experience:

Sarah Clover has acted for law firms and for barristers in relation to claims of professional negligence and regulatory issues arising out of a very wide range of work undertaken by them. For example, work in relation to pension schemes, high net worth divorces, family trusts, banking and finance, commercial property, litigation, commercial contract, AIM listings, to name but a few. She has also acted for firms in cases in which their partners or employees are alleged to have acted dishonestly.

In addition to the spectrum of non-contentious partnership matters, Clyde & Co LLP is noted for providing 'expert' technical and commercial advice to professional services firms on partner exits and facing professional liability claims. The team draws on a multi-disciplinary set-up; Sarah Clover leads on professional liability, Chris Holme on employment and Simon Vere Nicoll on corporate partnership issues. Holme has particular experience in advising law firms on claims arising out of partner redundancies. Gary Thorpe was instructed by Vitruvian Partners on its 40% investment in CFC Underwriting via a limited partnership structure.

The practice's expertise covers a number of sectors, including medical and healthcare, legal, accountancy, property, insurance and financial services.  The team defended a leading agricultural law solicitor (PW) in the Solicitors Disciplinary Tribunal (SDT), followed by a successful appeal in the Administrative Court, which overturned an SDT order striking PW off the roll. The department heads are Claire Petts, who regularly defends health professionals. including doctors, dentists and opticians, in disciplinary proceedings; and the 'extremely easy to work with and incredibly responsive' Fergal Cathie, who has a particular focus on complex disputes and regulatory investigations involving professionals, particularly in the legal and financial services sectors. Richard Harrison heads the firm’s lawyers’ liability group, Sarah Clover chairs the executive of the firm's UK professional and financial disputes team, and James Roberts heads the firm's accountants' liability and disciplinary group. Sam Holden  is a highly regarded legal director and Tim Crockford and consultant Judith Duffin  were hired from Gowling WLG and BLM, respectively.
