Position

Neil is a Partner in Clarke Willmott's Planning and Environment Team and acts for a number of leading institutions, national housebuilders, regional commercial developers, landowners, industrial and manufacturing concerns, and for a number of public sector bodies.

Clarke Willmott LLP has a strong track record advising commercial developers, housebuilders, social housing providers, local planning authorities and food retailers on planning issues arising from development projects, including drafting and negotiating s106 agreements, acting in judicial reviews and handling planning and highways agreements. On the housebuilder front, practice head Neil Baker (who splits his time between the Southampton and Bristol offices) acted for Persimmon on a s106 agreement for a 520-dwelling extension to a new neighbourhood in Andover, and acted for New Forest District Council an a planning agreement for a new residential development of 70 units at Fordingbridge, which involved requirements for part of the land to be used as public open space and strategic alternative natural greenspace. Also recommended are Karen Howe, who is noted for her expertise in highways and public rights of way issues, and Anne Jones, whose sector expertise covers housing, retail, hotel and leisure, minerals and waste.

Clarke Willmott LLP advises on environmental issues associated with planning and infrastructure development mandates and is also well-known for its experience in the agricultural industry. The team also assists individuals in non-regulatory environmental contentious claims. Indeed, senior associate Daniel Gill successfully represented a car wash owner against Bristol City Council regarding a series of complaints made by local residents concerning noise emanating from the client’s business. Department head Neil Baker advised a property developer on a threatened enforcement claim regarding the company’s alleged failure to complete relevant environmental surveys in relation to a particular site. Further, Karen Howe advised Crematoria Management on the need for a scoping opinion request in connection with the re-determination of a planning request for a new crematorium. Clarke Willmott LLP¬†has ‚Äėexcellent all-round knowledge‚Äô of the planning aspects of large residential and regeneration projects and regionally important infrastructure developments. Chris Charlton¬†is advising Cranbrook New Community Partners on a long-running new town development in East Devon, which is projected to bring around 7,500 dwellings. Department head Neil Baker¬†is acting for Curo Places in relation to a multimillion-pound regeneration project at Foxhill Estate in Bath. Similarly, Caroline Waller¬†is advising South Hams District Council on the general planning aspects of a major redevelopment of the Noss Marina. Also of note, Karen Howe¬†assisted Bath Abbey with the permission for certain refurbishments to be made to the Grade 1-listed abbey, in the face of objections by The Victorian Society. The team has also acted for a landowner client in relation to a NSIP.
