Position

Belinda is one of the senior partners in CMS Cameron McKenna LLP’s insurance and reinsurance group and has over 25 years’ experience of working for the insurance market. She handles both domestic and international insurance and reinsurance litigation and non-contentious insurance matters and specialises in banks and financial institution coverage and claims disputes, professional indemnity, in particular for brokers and actuaries. She has also been involved in a number of large high-profile and international energy matters, advising on coverage and claims arising out of project construction and fire/explosion losses and operational policies. Her portfolio of work also covers directors’ and officers’ liability, political risks and property insurance. Belinda was involved in the development of the firm’s own risk management product, ‘RISKaware’, to help major clients manage their risks; this programme won The Lawyer’s Client Care Award in 2002.

  • Access to justice: protective costs orders in planning challenges

    Third parties and competing developers have no rights of appeal to the Secretary of State against planning decisions. Disappointed applicants can appeal to the Secretary of State and can have the merits of the application reconsidered. The only remedy available to a disappointed third party is a challenge by way of judicial review in the High Court on a point of law. The sense of frustration and disempowerment this creates has not been helped by the increasing complexity of the planning process and the use of consultation to legitimise decisions that many perceive may already have been taken.
