Position

Partner advising on matters relating to energy, concentrating on electricity and gas and also water; specialises in restructuring, privatisation/M&A, sales and on regulatory and legal regimes generally, both in the UK and overseas; acts for National Grid Transco and took a leading role in the restructuring of the England and Wales electricity system, including devising the Grid Code with NGC and in revising the market to introduce the NETA, CUSC and now BETTA; also acts for Northern Ireland Electricity Plc, having a leading role in the restructuring and in the recent introduction of a new market to meet the requirements of the European TPA Directive and the current All Island markets introduction; continuing work for both includes advising on regulatory, commercial and operational matters; also has worked with other UK electricity utilities including DNOs and companies contracting with electricity utilities; has worked extensively on the European TPA Directive implementation in a number of countries. Overseas work has included advising in Australia, the US, Canada, New Zealand, India, the Philippines, South Africa, Greece, Ireland, Russia and Slovakia, where he recently sold the generation. Other overseas work includes preparing the new electricity legislation and structure for Saudi Arabia, and recently he advised on establishing a regional electricity market in the Balkans and the new electricity law and market in Slovakia.

Publications: various articles; speaker at conferences worldwide; appointed CBE 2001.

  • Access to justice: protective costs orders in planning challenges

    Third parties and competing developers have no rights of appeal to the Secretary of State against planning decisions. Disappointed applicants can appeal to the Secretary of State and can have the merits of the application reconsidered. The only remedy available to a disappointed third party is a challenge by way of judicial review in the High Court on a point of law. The sense of frustration and disempowerment this creates has not been helped by the increasing complexity of the planning process and the use of consultation to legitimise decisions that many perceive may already have been taken.
