Spratt Endicott’s biggest growth area is its debt recovery department, which is one of the largest solicitor-linked debt recovery practices in the South East.

Locally, the firm is a member of the Banbury Corporate Finance Initiative, working with other solicitors, accountants, banks and corporate finance advisers to provide local businesses with support in a wide range of corporate finance matters.

Types of work undertaken: Debt recovery: the department undertakes both pre-legal and contested recovery work for clients, and works closely with the dispute resolution department. Clients include leading top-tier banks, and companies in the telecoms, multimedia, accountancy, hygiene, recruitment and food services industries.

Property recoveries: the property recoveries unit supports landlords and managing agents with property management and possession proceedings. It offers tailor-made property management packages for clients to legally maintain property assets and agreements with tenants and mortgagees.

Commercial property: the department focuses on high-quality work, service and value. The team’s expertise ranges from support on major developments on behalf of large plcs, to individual business leases, landlord and tenant negotiations, and the acquisition, management and disposal of investment properties.

Company commercial: the department provides an expert, complementary skill set in corporate and commercial work, and has developed a particular specialist offering in the drafting and negotiation of high-value commercial contracts and other strategically important trading agreements on behalf of clients, which include national and international brands. Additional services include: mergers and acquisitions; MBOs; MBIs; joint ventures; share option schemes; corporate reorganisations; shareholder agreements and disputes; and trading agreements.

Dispute resolution: the department provides comprehensive expertise for clients, which include plcs; banks; accountants and other professional services; trading companies; and individuals. Specialist services include: breach of warranty; commercial injunctions; contract and IT disputes; professional negligence; shareholder and partnership disputes; property litigation; intellectual property protection; insolvency; contested probate and inheritance claims; and defended debt recovery.

Employment: the department has an excellent record of advocacy success in tribunals, and contentious and non-contentious advice, which includes: TUPE transfers; drafting terms and conditions of employment; disciplinary action; and compromise agreements. Recent cases have involved an increasing amount of discrimination and redundancy-related work.

Intellectual property: the department has expertise is in both contentious and non-contentious work, including trade marks, patents, copyright, and reputation management and protection.

Family: the department offers UK and pan-European family services, and has specialist experience in matters involving the Children Act and collaborative law.

Private capital: for private clients, including executives and high-net-worth clients, the department’s services include tax, estate planning, trusts, charity law, wills, probate and estate administration.

Property plus: the property plus department deals with high-value properties and complex transactions, as well as estates and agriculture.

    In Nzinga Maswaku v Westminster City Council [2012] EWCA Civ 669 the Court of Appeal clarified that in offering a homeless person with alternative temporary accommodation the local authority is obliged to point that if the offer is refused it has discharged its Part VII duties under the Housing Act 1996.

    In Harrow LBC v Ayiku [2012] EWHC 1200 (Admin) Sales J held that the word “or” in the Council Tax (Exempt Dwellings) Order 1992, art 3 Class N, had a disjunctive meaning, therefore it was sufficient for the non-British spouse of a foreign student to satisfy one or other of the two conditions, namely being prevented from taking paid employment or being prevented from claiming benefits, in order to qualify as a “relevant person” who was exempted from liability to pay council tax.

    In R (Calver) v Adjudication Panel for Wales [2012] EWHC 1172 (Admin) Mr Calver was a member of Manorbier Community Council who successfully challenged the decision of the Panel to dismiss his appeal against a decision by Prembrokeshire County Council Standards Committee censuring him for a number of comments or blogs posted by him on a website he owned and controlled.

    The Judgment of Lindblom J in The Manydown Co Ltd v Basingstoke and Deane BC [2012] EWHC 977 (Admin) repays attention. The Claimant sought to challenge by judicial review 2 decisions of the Council: (1) the Council’s refusal to reconsider its position on the development of a site that it owns (and is the subject matter of a Joint Development Partnership Agreement with the Claimant); and (2) a decision of the Council’s Cabinet approving a selection of sites for development which did not include this site.
