Under the leadership of ‘banking starSergio Barboza, DLA Piper Pizarro Botto Escobar fields a compact but ‘outstanding’ practice that acts across a wide range of banking and financing matters, with a distinct banking regulatory bent. The team advised Proparco on a $10m secured loan to Cooperativa de Ahorro y Crédito Pacífico, to finance the cooperative’s lending activities. Ricardo Escobar is hailed as ‘particularly knowledgeable’, and recently assisted the Inter-American Development Bank with a $30m senior unsecured A/B term loan to Financiera Confianza for the expansion of one of its projects. On the regulatory side, the team is representing Mexico’s Banco Azteca on the evaluation and implementation of FATCA policies in its Peruvian subsidiary, Banco Azteca del Perú. New clients in 2016 include Microvest, Triodos Bank and Asociación Solaris Perú. We are saddened to report that name partner Luis Pizarro passed away after suffering a heart attack in August 2017.

New to this ranking, DLA Piper Pizarro Botto Escobar continues to raise its profile on the back of its involvement in an increasing share of noteworthy deals, including company stock sales and asset acquisitions. The firm’s recent association with global player DLA Piper will undoubtedly be a source of referrals and improve its international reach. Notable mandates saw departmental head Luis Vargas assist Ripley regarding former joint venture Aventura Plaza’s transfer of assets and liabilities through its partial spin-off. In another highlight, Vargas assisted the Atlanta-based Logfire with the indirect sale of its Peruvian subsidiary Logfire Perú to Oracle through a merger agreement; and also advised Macrocapitales firstly on its acquisition of a 78% stake in Pastipan, and susbsequently on its purchase of a 45.8% stake in Dresden Lab. On the corporate side, the team advised Armas Doomo-Inversiones on a new joint venture with leading institutional real estate investment fund manager Paladin Palardo Investors, creating an entity (Palardo) for the development of middle-income housing in Peru. Other clients include Graña y Montero, British American Tobacco Peru and Viva GyM. Senior associates Janilú Badiola and Claudia Gonzales are active on the team’s major mandates.

DLA Piper Pizarro Botto Escobar’s credentials in the construction and infrastructure disputes arena are widely recognised. The team regularly takes on complex construction claims in relation to cost overruns, price adjustments, force majeure, contract interpretation and indemnification claims, and also takes a leading role representing major construction companies in arbitration proceedings related to PPP projects. Key partner Carlos Núñez is representing Construções e Comercio Camargo Correa, as contractor, in a $70m arbitration procedure against the Regional Government of Piura over the termination of a construction contract concerning an irrigation project. He is also representing Metro de Lima Línea 2 against regulatory agency OSITRAN regarding the execution of the $6.6bn PPP contract for the development of the Línea 2 project. Guillermo Hesse has experience in commercial disputes, and is representing Empresa de Transformación Agraria in a number of arbitration procedures against Programa Nacional de Saneamiento Rural related to three contracts for the construction of basic sanitary units and water supply systems in Southern Peru.

Ongoing highlights include advising Intersur Concesiones on contractual, project financing, regulatory and arbitration matters in relation to its $600m inter-oceanic toll road project (Trench 4), which is the first PPP project developed under a co-financed concession mode.
