Position

Senior partner. Andrés heads the Litigation and Arbitration group of BMAJ. His practice areas are Civil and Commercial Litigation, Criminal Defense, International and National Arbitration, Bankruptcy and Insolvency and Public International Law.

Career

Andrés has vast experience as counsel, arbitrator and expert in international disputes involving commercial, investment and international public law issues, before the International Court of Justice, the International Centre for Settlement of Investment Disputes (ICSID), the International Chamber of Commerce (ICC), the London Court of International Arbitration (LCIA), the American Arbitration Association (AAA), the Stockholm Chamber of Commerce (SCC), several ad hoc tribunals, as well as domestic courts in different jurisdictions, including Chile, United Kingdom, the Netherlands, United States and Argentina. 

Andrés acts as counsel for States and investors in Investor-States disputes and sits as arbitrator in ICSID cases. He was legal advisor for the Republic of Chile in the maritime border dispute between Chile and Peru before the International Court of Justice and is currently a member of the Chilean legal team in the dispute between Bolivia and Chile in front of the same court. He has rendered legal advisory services to several governmental organizations in different countries, providing among others advice to the government of Chile during negotiations of the financial services and investment chapters of the Free Trade Agreements with Canada, Mexico, the United States and the European Union.

Andrés is a member of the list of arbitrators of the International Centre for Settlement of Investment Disputes (ICSID) and the list of arbitrators of the Arbitration and Mediation Center of the Santiago Chamber of Commerce (CAM Santiago). Arbitrator and party counsel under the rules of ICSID, ICC, LCIA, CAM Santiago and in ad hoc arbitrations.

Education

Andrés graduated summa cum laude from the Universidad de Chile Law School (1989). He holds an LL.M. degree from Harvard Law School (1995).

Bofill, Mir & Álvarez Jana fields a highly regarded, 17-strong disputes practice. The civil and commercial litigation team is well known for public-interest litigation, while the firm's arbitration practice area stands out for its experience in construction, commercial law and gas, natural resource and energy disputes. Recent work saw the team advise Mineria Candelaria in a $41m claim brought by a community of fishermen alleging contamination of the waters around Punto Padro Port as a result of the incorrect loading and unloading of copper. Other matters include the successful defence of Bayer in a $1.4m tort case, representing CORFO in $40m and $150m damages claims and Minera Los Pelambres in a $10.5m civil liability case concerning water rights. The team underwent change in January 2019 when former litigation and criminal defence co-head Rodrigo Quintana exited (with former senior associates Ignacio Ried and Camila Flores) to establish QRF Abogados; the firm moved rapidly hiring former Gutiérrez, Waugh, Jimeno & Asenjo senior associate, Karen Werner, as partner, the same month. A civil litigator, Werner joins a team composed of name partner Andrés Jana, who leads the firm’s litigation and arbitration practice; all-round arbitral specialist Rodrigo Gil; and domestic arbitration-focused senior associate Carla Dittus.
