Gustavo P. Giay specialises in IP litigation and leads the work of Marval’s highly successful Enforcement Unit. His practice has focused on trademark piracy and he has extensive experience in advising businesses and individuals in matters related to managing intellectual property portfolios, including contractual and licensing agreements. He also offers advice on Internet Law issues and assessment on legal and contractual questions in new and developing technologies.

He is a licensed Intellectual Property Agent and is a member of INTA, the Argentine Association of Industrial Property Agents (AAAPI), the International Association for the Protection of the Industrial Property (AIPPI), and of Licensing Executive Society (LES).


He graduated as a lawyer from the Universidad de Buenos Aires in 1994 with a concentration in business economics and in 1997 he earned his LLM degree from Northwestern University in Chicago, Illinois. In 2002 he completed a postgraduate course on Intellectual Property at the Universidad de Palermo in Buenos Aires.

Over the past year Marval, O'Farrell & Mairal’s department, which is well weighted between technology, media and telecoms clients, acted on a steady stream of regulatory and transactional mandates, including licensing issues, privacy and data protection matters and corporate finance deals. Daniel Di Paola co-leads the practice and acted alongside the M&A and competition teams to advise Turner on its joint, five-year contract with Fox for the audio-visual rights (including TV) of Argentine football. In another key highlight, practice co-head Javier Etcheverry Boneo advised Cell Site Solutions on the development of telecoms infrastructure in Argentina. IT and internet law specialist Gustavo Giay co-heads the practice and brings to bear a strong record in contentious and regulatory matters. Other representative clients include América Móvil, British Telecom LATAM and Microsoft.
