Position

Carlos de Icaza has actively represented major industrial groups, real estate investment trusts, development companies and private equity funds, involved in the industrial, tourism, retail and housing sectors, requiring environmental, real estate and transactional advice for their Mexican ventures. On the environmental side, among various other matters, Mr. de Icaza has recently advised a large multinational doing business in Mexico in successfully completing a large remediation of a heavily contaminated site and in its further sale to a third party for subsequent redevelopment.

On the real estate side, among others, Mr. de Icaza advised last year a large Mexican real estate fund in the sale of 19 shopping centers to a Mexican REIT (FIBRA) for an amount exceeding US$600 Million dollars. Among his most representative recent transactions Mr. de Icaza advised Mexico Retail Properties (an affiliate of Black Creek Capital) in the sale of 49 retail properties located in 20 jurisdictions throughout Mexico to Fibra Uno (the first and largest REIT in Mexico), for a price of over US$2 Billion Dollars. This transaction closed in December 18, 2013, and was at that point in time the largest real estate transaction in terms of purchase price in the history of Mexico.

Over the past decade Mr. de Icaza has been consistently ranked as a leading and/or highly recommended attorney by several publications including Who’s Who Legal, Practical Law Company, Chambers and Partners, Latin Lawyer and The Legal 500. Mr. de Icaza obtained the Client Choice Award for the category of Environmental Law in Mexico, from the International Law Office/Client Choice Awards organization during two years in a row, in 2013 and 2014.
Mr. de Icaza is a frequent speaker on environmental and real estate matters and has written various articles and papers on different legal subjects.

Mr. de Icaza worked as a Foreign Associate in the Los Angeles office of Paul, Hastings, Janofsky & Walker in 2000 and 2001.

Education

Mr. de Icaza received his law degree (JD) from the Instituto Tecnológico Autónomo de México (ITAM) in Mexico City in 1997, and obtained his LL.M degree from McGill University in Montreal, Canada in the year 2001. Mr. de Icaza studied a Post-Graduate Course on International Commercial Arbitration in 1997 from the Escuela Libre de Derecho in Mexico City, and a Post-Graduate Course on Environmental Law, in 1998, from the Instituto Tecnológico Autónomo de México (ITAM) in Mexico City.

It also acted for Trinity Investments, Walton Street Capital, and Oaktree Capital Management on their indirect acquisition of the Mexican entities that hold interest in the real estate property known as Hilton Los Cabos Beach & Golf Resort located in Los Cabos, Baja California Sur; and for W.P. Carey in the $17m acquisition and lease-back of an industrial building located in the state of San Luis Potosi. In the FIBRA area, the team advised FIBRA Macquarie Mexico on the sale of 35 non-strategic industrial assets from the portfolio of FIBRA Macquarie Mexico; and FIBRA Prologis on the $64.5m acquisition of three industrial properties. Carlos de Icaza and Francisco Montalvo lead the team from Mexico City and Monterrey, respectively. De Icaza is highly valued for his leadership, while Montalvo is a ‘solid real estate lawyer: business-oriented and well known in the market as one of the best’. Working alongside him in Monterrey, the very active Badir Treviño-Mohamed is valued for his ‘attention to detail, client involvement, and commercial sensibility’. Mexico City-based Carlos del Río is also recommended.   • Notorious Marks

    Notorious marks or the declaration thereof, has always been an issue widely discussed in Mexico by the IP legal community. This is so because provisions of the Paris Convention dealing with this topic have for a long time been uses as an effort to cancel or nullify trademarks registered by Mexican authorities without really making an extensive evaluation of proposed denominations and without examining in depth if such marks may be potentially affecting rights acquired by third parties elsewhere. So, a specific regulation and legal frame that at least tries to resolve this issue is always a good start in the right direction.
