Paul practised at the commercial Bar in London for 20 years and then in Bermuda before becoming Head of Litigation at the Cayman Islands office. His practice covers all aspects of dispute resolution with specialist expertise in commercial litigation, arbitration and trust litigation. He deals with commercial disputes of all types, fraud and asset tracing, insurance, insolvencies and restructurings, shareholder and corporate disputes and trust disputes.

Paul is co-author of the Bermuda chapter of “Global Financial Crisis; Navigating and Understanding the Legal and Regulatory Aspects” and the Bermuda chapter of "International Trust Disputes" (OUP, 2012).

Headed by Paul Smith, Conyers Dill & Pearman's litigation and restructuring team is highly rated for domestic and cross-border insolvency and restructuring proceedings, complex contract and commercial disputes, multi-party contentious trusts and estates matters, and a broad range of local litigation. It acted for the Torchlight Fund and its general partner in defending a just and equitable winding-up petition brought against it by a number of its investors. Other highly rated practitioners are Fraser Hughes, Ben Hobden, counsels Bernadette Carey and trust litigator Robert Lindley, and associates Erik Bodden and Spencer Vickers.

Insurance/reinsurance

Conyers Dill & Pearman's Cayman team advises on a broad range of insurance-related transactions, including M&A, regulatory advice for all licenses, and transfer by way of continuations for licensees, both into and out of the jurisdiction. It also handles catastrophe bonds, structured insurance products and insurance litigation and insolvency work. In a complex deal that involved a review of policy wordings and deal terms, it acted for MetLife on a joint venture transaction with a large Cayman reinsurer, which included advising on a co-insurance policy structure. Other highlights include advising Clifford Allen Associates on setting up two companies, as well as applying for an insurance broker's licence to provide student insurance plans tailored for international students attending private secondary schools in the US. The practice hired the 'experienced and capable' Derek Stenson, who is highly rated for his advice to a wide range of international financial and insurance institutions on insurance and reinsurance law and regulation, from Walkers. Other key names are Kevin Butler, who heads the firm's Cayman office and corporate practice, and Richard Fear. On the contentious side, Paul Smith and Fraser Hughes are recommended.

Trusts/private client

Conyers Dill & Pearman's client base includes individuals, families, and corporate clients (including trustees) and private trust companies, all of which the team advises on family trust structures and on the management and maintenance of those structures. Representative matters include inheritance structuring, private investment structures, inter-generational asset transfers, and regulatory laws; the practice also has a robust contentious trusts specialty. The team recently assisted with the establishment of a new pension fund for employees in Cayman, including assisting with the regulatory approvals and set-up of the pension plan. Counsel Robert Lindley is Cayman and BVI private client and trust head, Paul Smith is an experienced trust litigator and Bernadette Carey is another highly regarded counsel.
