Areas of practice

The London office specialises in cross-border business and finance transactions, intellectual property and international commercial dispute resolution. The London transactional practice is headed by Zoe Ashcroft and handles cross-border mergers and acquisitions, strategic alliances and joint ventures, private equity investments and venture capital financing across a range of industry sectors, including oil and gas, renewable energy, financial services, manufacturing and consumer products. Winston’s London lawyers have significant experience in securities and banking, syndicated loans, US and UK public and private offerings for foreign issuers and dual New York/London listings of securities, acting for lenders, borrowers, underwriters and issuers.

Richard Price and Dr Gareth Morgan joined the London office in 2011 and have grown a team of associates and consultants advising on intellectual property/dispute resolution matters. They bring with them extensive experience and a formidable track record of success in protecting against and litigating all forms of intellectual property dispute, often to the highest courts in both England and Europe. Mr Price has litigated many landmark cases and recently patents in the Patents Court and Court of Appeal relating to coronary devices (stents), GM crops and also breathable, waterproof membranes in shoe soles. In addition, he advises clients in trade mark matters, and has an active OHIM trade mark dispute practice. Dr Morgan has also acted in many landmark IP (patents, copyright and SPCs) cases in the English and European courts over the last decade including biotechnology cases concerning recombinant proteins, monocolonal antibodies and GM crops. The group advises on medicines regulatory and patent/SPC litigation for clients, helping co-ordinate litigation when challenging or enforcing exclusivity rights relating to biotechnology, pharmaceutical and medical device products. Michael Madden has joined the London office in 2012 to head up and build a commercial litigation practice.     In Nzinga Maswaku v Westminster City Council [2012] EWCA Civ 669 the Court of Appeal clarified that in offering a homeless person with alternative temporary accommodation the local authority is obliged to point that if the offer is refused it has discharged its Part VII duties under the Housing Act 1996.

  • COUNCIL TAX

    In Harrow LBC v Ayiku [2012] EWHC 1200 (Admin) Sales J held that the word “or” in the Council Tax (Exempt Dwellings) Order 1992, art 3 Class N, had a disjunctive meaning, therefore it was sufficient for the non-British spouse of a foreign student to satisfy one or other of the two conditions, namely being prevented from taking paid employment or being prevented from claiming benefits, in order to qualify as a “relevant person” who was exempted from liability to pay council tax.

    In R (Calver) v Adjudication Panel for Wales [2012] EWHC 1172 (Admin) Mr Calver was a member of Manorbier Community Council who successfully challenged the decision of the Panel to dismiss his appeal against a decision by Prembrokeshire County Council Standards Committee censuring him for a number of comments or blogs posted by him on a website he owned and controlled.

    The Judgment of Lindblom J in The Manydown Co Ltd v Basingstoke and Deane BC [2012] EWHC 977 (Admin) repays attention. The Claimant sought to challenge by judicial review 2 decisions of the Council: (1) the Council’s refusal to reconsider its position on the development of a site that it owns (and is the subject matter of a Joint Development Partnership Agreement with the Claimant); and (2) a decision of the Council’s Cabinet approving a selection of sites for development which did not include this site.
