Position
Franz Schwarz is a partner in the firm’s litigation/controversy department and vice-chair of the International Arbitration Practice Group. Mr Schwarz focuses on complex, multi-jurisdictional disputes. He has extensive experience with arbitral practice, procedure and advocacy, both in civil and common law systems. Mr Schwarz has been involved, as counsel and arbitrator, in close to 100 arbitrations, both in ad hoc proceedings and before all major arbitral institutions, at various seats and governed by a broad variety of substantive and procedural laws. He has a particular focus on join ventures, M&A, financial services and project finance, as well as commercial and corporate disputes. Mr Schwarz regularly counsels clients on conflict of laws issues and international enforcement of arbitration awards and judgements, including against state entities, and frequently advises parties on the protection of foreign investments under bilateral investment treaties and similar instruments. Mr Schwarz frequently serves as arbitrator, including as chairman of arbitral tribunals, and is included on the roster of several major arbitral institutions.
Career
Joined WilmerHale 1999; lecturer in international arbitration, University of Zurich 2003 to date; founding member executive board ICDR’s Young & International Arbitration programme, 2003-07; received the Swiss Arbitration Association’s inaugural Award for Advocacy in International Arbitration (see www.arbitration-org.ch) as well as the American Arbitration Association’s Distinguished Service Award ‘for his distinguished service and support of international arbitration and mediation’; lecturer in international arbitration, University of Economic Studies, Vienna 2008 to date. Publications: ‘The Vienna Rules – A Commentary on International Commercial Arbitration in Austria’ (Kluwer Law International, 2009); ‘The Procedural Order Public in International and Austrian Arbitration Law’ (‘Austrian Arbitration Yearbook 2008’, Manz); and numerous articles in the field.
