White & Case LLP is widely recognised for its ability to handle high-value arbitration, most recently demonstrated in its  ongoing representation of Grupo Unidos por el Canal (and its shareholders), in a dispute with the Panama Canal Authority relating to the US$5.5bn Panama Canal expansion project, among other cases. The arrival of Silvia Marchili and Jorge Mattamouros from King & Spalding LLP in January 2019 has added significant experience in general and construction arbitration, while the mid-August hire of up-and-coming senior associate Ricardo Chirinos from Freshfields Bruckhaus Deringer LLP has further strengthened the bench. Nevertheless, Jonathan Hamilton remains the primary contact: his impressive recent international instructions include representing the firm's major client Republic of Peru in a $250m ICSID arbitration relating to the development of a port, and in a separate matter, acting for the same client in a $1.9bn UNCITRAL investment arbitration brought under the US-Peru Trade Promotion Agreement pertaining the 1969 agrarian reform bonds and related issues. Other notable practitioners include Mexico city-based Rafael Llano Oddone, who assisted Jindal Steel & Power with a dispute against a Bolivian state-owned mining entity, and New York-based Ank Santens, who represented MetLife in a claim against Argentina under the US-Argentina bilateral investment treaty. Andrea Menaker, Carolyn Lamm, the recently promoted partner Francisco Jijón and senior associate Michelle Grando are other names to note.

The practice appears as counsel in some of the largest commercial and investor-state arbitrations in the world and its London team conducts its own advocacy. The group is particularly noted for international arbitrations involving complex international energy and infrastructure project disputes, and it has experienced an increase in shipbuilding disputes. It also fields experts in work emanating from Russia and the Commonwealth of Independent States (CIS), Africa, Lusophone jurisdictions and Asia. Phillip Capper and Aloke Ray QC, who took silk in 2019, are the practice co-heads; Russia and CIS expert David Goldberg divides his time between the London and Moscow offices; and Mark Clarke is the London oil and gas disputes head. Also key to the group are Clare Connellan, Edward Attenborough, Paul Brumpton, and Dipen Sabharwal QC, who is head of the EMEA disputes section for international arbitration and also took silk in 2019. David Robertson was hired from Bryan Cave Leighton Paisner LLP primarily to focus on construction arbitration; investment treaty arbitration specialist Andrea Menaker moved to London from the firm's Washington DC office; and James Holden made partner.

Led by New York-based¬†Paul Friedland,¬†the team has been acting for the Republic¬†of¬†Uzbekistan on six matters, including securing the successful dismissal of a $132m ICSID case brought by Spentex Netherlands for alleged violations of applicable investment laws. The practice group is also acting for the¬†Russian Federation in cross-border legal proceedings pertaining to the shareholders in YUKOS, who are seeking to recover in excess of $50bn on the basis of arbitral awards issued in 2014.
