Owen Pell, Bryan Merryman in Los Angeles and Washington DC-based Christopher Curran acted for Toshiba Corporation in a case regarding American depository receipts in which plaintiffs asserted that a foreign issuer is subject to the US Exchange Act even if it has not sponsored an ADR program in the US.
