Noted for its aviation focus, the practice has seen an increasing number of instructions from export credit agencies and multilaterals such as China Development Bank. 2008 saw the firm acting for European ECAs and BNP Paribas on the financing of two Airbus A330 aircraft for AirAsia X.

While Joel Hogarth continues to draw praise for his ‘extensive knowledge of corporate finance’, his workload has become more acquisition focused with a number of private equity clients instructing him. William Kirschner recently relocated to Singapore.

Lovells Lee & Lee has a track record as ‘one of the best institutional PPP practices in Singapore’, with Brad Roach’s arrival from White & Case LLP International Lawyers strengthening its regional energy practice. Key highlights in 2008 include advising on the financing of the $4.4bn Sentosa Integrated Resorts project, as well as PT Medco’s financing of a greenfield upstream LNG liquefaction project in Indonesia. James Harris and Alex Wong are highly regarded.

The loss of energy specialist Brad Roach to Lovells Lee & Lee has been a blow to White & Case LLP International Lawyers. Nonetheless, it still maintains an active presence in the market through ‘articulate and knowledgeable’ Brian Miller, Doug Peel and Sebastian Buss, newly arrived from the firm’s London office. It has the capacity to work alone, such as acting for the lender on an Indian toll road project, or in conjunction with its international network as with the $20bn Sakhalin 2 LNG project in Russia.

William Kerschner relocated to White & Case LLP International Lawyers’s Singapore office in January 2009, and advised on the sale of Lehman Brothers’ Indian businesses to Nomura Holdings.

Offshore market

Within Offshore market,

Allen & Overy, Clifford Chance, Herbert Smith LLP, Latham & Watkins LLP, Norton Rose (Asia) LLP and White & Case LLP International Lawyers were the six recipients of QFLP licenses awarded by the Singaporean government. Allen & Overy and Clifford Chance split from their joint law ventures with Shook Lin & Bok LLP and WongPartnership LLP as a result. Allen & Overy also acquired local law firm Venture Law LLC in order to boost its Singapore law offering.

  • SINGAPORE HIGH COURT CLARIFIES SCOPE OF FORCE MAJEURE AND TERMINATION CLAUSES

    The Singapore High Court has ruled that a rise in prices of sand, caused by a ban on sand exports (the “sand ban”) by the Indonesian government in January 2007, did not constitute a force majeure event which would relieve a concrete supplier of its obligations to supply concrete to a construction company. The court also highlighted the importance of being clear and unequivocal when communicating one’s intention to terminate a contract.

    Monetary Authority of Singapore (“MAS”) advocates that Islamic finance products shall receive similar regulatory treatments as the conventional finance products.
