Kate is a principal associate in our intellectual property group. She advises on all aspects of intellectual property, specialising in branding, the internet and technology. 

On the contentious side, Kate has substantial experience in advising clients in relation to a wide range of IP disputes. Her experience includes acting in the following reported cases:

  • on behalf of the successful party in Arrow Nominees v Blackledge (Court of Appeal) - a leading case on the court's powers to strike out claims under the CPR;
  • Markem Corporation Inc v Zipher Limited (Court of Appeal) - a leading case on patent entitlement;
  • LB Europe (trading as DuPont) -v- Smurfit Bag-in-Box SA - an authority for groundless threats of patent infringement claims;
  • Excelsior Productions -v- Yorkshire Television Limited - a key decision in the media industry relating to the payment of fees for the broadcast of repeat transmissions of programmes (including The Darling Buds of May and A Touch of Frost) on digital stations;
  • Specsavers International Healthcare Limited  -v- Asda Stores Limited (Court of Appeal) a trade mark infringement dispute relating to a marketing campaign ran by Asda.

Kate has also acted on behalf of numerous clients in respect of various domain name disputes, including filing complaints under the UDRP and Nominet's Dispute Resolution Service.

On the non-contentious side, Kate has worked closely with many clients advising on the protection and exploitation of their brand names and technology.  She also undertakes due diligence audits and has acted for numerous clients in connection with the drafting and negotiation of licences and assignments.

Eversheds Sutherland (International) LLP is able to assist with the exploitation and monetisation of IP rights through licensing, promotions and commercial agreements, as well as handling the core aspects of trade mark portfolio management, enforcement and prosecution, including advising on the seizure of counterfeit goods and managing online content. Andrew Terry advises on all aspects of trade marks, copyright, design rights, advertising and reputation management matters. Head of brands Kate Ellis is another name to note. Neil Mohring left for Apple Corps and Harrisongs in February 2019.
