Paula is a partner in the Insurance & Reinsurance team within our Financial Institutions Group. She advises insurers, insurance intermediaries, other financial services firms and businesses outside the financial sector on contentious and non-contentious insurance issues.

Her experience includes the drafting and negotiation of insurance market agreements, including binding authority agreements and claims handling agreements and the drafting and negotiating of insurance policy wordings in all classes of commercial business.

Paula also advises clients whose primary business is not insurance on issues arising from their involvement in the sale of insurance products, including the regulatory implications of doing so and the associated contractual documentation.

Her recent non contentious experience includes:

  • advising upon whether particular warranty products are contacts of insurance; 
  • drafting commercial combined, fidelity and directors and officers policy wordings; 
  • drafting binding authority agreements for various lines of business.

She regularly advises on disputes in relation to insurance market agreements and policy coverage. Paula also has extensive experience in handling professional indemnity disputes, specifically in relation to accountants, insurance brokers and stockbrokers.

Cases in which she has acted include:

  • Bank of Scotland v Euclidian (no.1) Ltd [2007];
  • Goshawk dedicated No.2 v the Governor and the Bank of Scotland 2006 2 All ER 60;
  • Bedfordshire Policy Authority v DA Constable & Others 2008 EWHC 1375

The Eversheds Sutherland (International) LLP team is ‘excellent and provides great value for money’. Major clients such as XL Catlin, AON, RiverStone and AIG come to the firm for its ‘responsive, helpful and proactive’ approach. The team in London has advised on disputes connected to several other jurisdictions, in collaboration with its insurance colleagues in the firm’s network of over 60 foreign offices. This international reach has increased since the merger with US legacy firm Sutherland Asbill & Brennan, which took effect on 1 February 2017, with the firm acquiring a number of US market-leading insurance practitioners. The particular strength of its real estate practice group gives the team a competitive advantage, as does the 25 years’ experience in insurance coverage disputes of practice head Simon Brooks. Another asset for the team is high-profile financial and professional risks expert Naz Gauri. Recent highlights include representing the successful defendant Motorplus in a claim brought by a firm of solicitors against the legal expenses insurance underwriting agency. Taking the lead in this case was Paula Gaddum, who was also instructed by Guarantee Protection Insurance to bring a claim against a Lloyd’s broker which had allegedly acted outside of its authority in concluding overseas insurance contracts.

Eversheds Sutherland (International) LLP's practice covers the full breadth of transactional and regulatory advice, and also boasts a strong technology team acting on FinTech and InsurTech corporate transactions. The ‘responsive and personableHugo Laing ‘has deep knowledge of the law’; he handled high-profile matters including advising Legal & General on longevity insurance covering £800m of pensioner longevity risk in the Scottish Hydro-Electric Pension Scheme, the first transaction to use Legal & General’s “UK-based pass through" structure to transfer longevity risk to the end reinsurer. The team also advised Markel on an unusual matter involving its acquisition of EC Insurance Company, a specialty line insurer providing insurance to contractors and affinity groups. Manchester-based Paula Gaddum is also a key member of the team.

Jardine Lloyd Thompson Group, Aon, HCC International Insurance Company, KPMG, XL Catlin and Lockton Companies are among its clients. Claire Carroll regularly defends claims brought against pensions professionals, trustees and advisers, and is acting for a global consultancy and the trustee of one of its occupational pension schemes in a potential professional negligence claim in relation to the possible overpayment of tax-free lump sums to more than 100 members of an occupational pension scheme. Practice head Simon Brooks, who has a ‘good understanding of the law and a common-sense approach to legal issues’, is experienced in claims against insurance brokers, lawyers, accountants and construction professionals. Matthew Allen handles claims involving finance professionals and Paula Gaddum is active across claims involving accountants, solicitors, construction professionals and brokers. Jennifer Miles and Frank Thompson are also key members of the team, as are principal associates Kate Hill and Christopher Ives, who is based in Manchester, and senior associate Naz Gauri.
