Alongside head of litigation Mark Yeadon, Ferguson is representing the regulator in judicial review proceedings brought by Hong Kong Telecommunications challenging The Communications Authority's decision not to approve its application to challenge the technical standard used under its mobile carrier licence. The team is also picking up a significant amount of competition work within the aviation sector, including its recent work for a major international airline on the production of a bespoke competition law e-learning programme to be provided to all airline employees globally. Eversheds Sutherland generates a consistent flow of repeat work from banks and corporate borrowers, thanks to its coverage of a wide ambit of financing transactions across the general commercial banking spectrum. One of the firm's main areas of strength is trade finance; within this space, Asia practice head Michael Yau is knowledgeable about account receivables financing, supply chain financing and structured trade finance. Real estate finance is another notable pillar of the firm's practice, with its team undertaking a significant amount of transactional work for PRC/Hong Kong real estate developers. The firm also draws upon its strengths in areas such as construction, corporate and tax to assist a wide range of parties (including sponsors, lenders and investors) with project finance transactions. With practitioners in Beijing and Shanghai focused on inbound and outbound matters, the Hong Kong team has a particular specialism in Asia-Pacific regional transactions and wider global deals. The group includes Charles Butcher, who has been instrumental in the growth of the practice; he recently led a cross-office team that acted for Baird Capital on its acquisition of an indirect interest in the Malaysia-based Nirvana Asia via a vehicle controlled by Nirvana's founder and CEO. Butcher also co-led an international team that advised global architecture and design firm Perkins+Will on its acquisition of Danish outfit Schmidt Hammer Lassen Architects. Under the leadership of Stephen Mok, the team is particularly active in complex offerings including groundbreaking listings. Mok recently led a team that included Norman Hui and consultant Sin-Joh Chuang in advising Datang Power on its non-public issuance of A-shares to its controlling shareholder (China Datang Corporation, hereafter CDC), and also its non-public issuance of H-shares to a wholly owned subsidiary of CDC for circa $2.1bn; this marked the first time a whitewash waiver was used in Hong Kong for such issuances. Mok, Hui, Amy Yu and others acted as Hong Kong counsel to Precision Tsugami (China) on its $64m spin-off listing on the Main Board of the Hong Kong Stock Exchange; this listing was the first in Hong Kong to involve a spin-off from a Japanese company listed on the Tokyo Stock Exchange. In addition, Mok's team served as Hong Kong legal advisers to Nomura as the sole sponsor on Nissin Foods' circa $121m spin-off listing on the Main Board; this was the second listing in Hong Kong to involve a spin-off from a Japanese company listed on the Tokyo Stock Exchange. Beyond new listings and follow-on offerings, other work included Mok and others advising listed company New World Department Store (China) on its proposed privatisation by parent firm New World Development.
