Position

Eric W. Dittmann is a partner in the Litigation practice of Paul Hastings. Mr. Dittmann focuses his practice on intellectual-property litigation and client counseling in both district courts and the Federal Circuit, with an emphasis on complex, high-stakes patent actions. Mr. Dittmann has experience with a broad range of technologies in the pharmaceutical field, including antiemetics, antiplatelet agents, sleep aids, direct thrombin inhibitors, proton-pump inhibitors, dopamine agonists, and antihypertensive agents. He has also represented and counseled a diverse group of clients in patent matters relating to a wide array of other technologies, including medical devices, software applications, and electronic devices. Mr. Dittmann was recently recognized as a rising star by Law360.

Served as a judicial law clerk to the Honorable Alan D. Lourie of the United States Court of Appeals for the Federal Circuit. Member of the State Bars of New York and New Jersey, and is admitted to practice in the United States Court of Appeals for the Federal Circuit and the United States District Courts for the Southern District of New York, the Eastern District of New York, and the District of New Jersey. He is also admitted to practice before the United States Patent and Trademark Office.

The 'very dedicated' team is a go-to-practice for PTAB litigation, especially for petitioners; it is primarily active in life sciences litigation, especially in pharmaceuticals and biotechnological cases, but is also instructed by clients in the technology and telecoms industries. A recent success was the defense of Trend Micro against Intellectual Ventures in a Federal Circuit case in which co-chair Yar Chaikovsky from Palo Alto secured a rare grant for attorney's fees from the court, winning the full $441,000 for the client. Together with his Washington DC-based co-chairs, Joseph Palys and Naveen Modi ('a top-notch advocate') Chaikovsky obtained an affirming decision from the Federal Circuit on behalf of HTC in a consolidated case against Virginia Innovation Sciences and Amazon, obtaining dismissal of over 360 claims covering eight patents as ineligible. Helsinn Healthcare, Boehringer Ingelheim and Sumitomo Dainippon Pharma are also among the team's clients. Eric Dittmann and Joseph O’Malley in New York impress with their 'passion, dedication, experience' and 'amazing ability to master the nuances and complexities of cases'.
