Areas of practice: 

Dispute resolution: Orrick focuses on high-value, complex, com­mercial litigation and international arbitration in the Asia-Pacific region. The team advises on a wide range of multijurisdictional commercial disputes on antitrust, product liability, interna­tional arbitration, FCPA, UKBA, white collar criminal activities and compliance investigations. The team also counsels clients on managing risks across a range of data privacy- and cybersecurity-relevant issues. Recently, Orrick represented a Japanese multinational company in the first international commercial mediation proceeding before the JCAA. The China team successfully defended China National Building Materials Group in a USD$1.3 billion US class action lawsuit for alleged defective drywall building materials.

M&A and private equity: Orrick has a long history advising on cross-border M&A, joint ventures and other commercial transactions. The China team is experienced in representing major Chinese state-owned and private enterprises in outbound investments, private equity financings and going-private transactions. The team advised on the USD$2.5 billion financing of its subsidiary JD Logistics and represented Qingdao Haier on its EUR€475 million investment in Italy-based Candy Group. The Tokyo team advises global investors with Japan-based interests.

Investment funds: Over the past 25 years, Orrick has advised on the formation of many of the first Asia-based hedge funds and private equity funds, and their pioneering cross-border investments in multiple jurisdictions. The firm has represented one of the largest Asian government entities in its cross-border investments since the commence­ment of its alternative investment program in 2008. Significant clients include China Resources Capital Management, Morgan Stanley Wealth Management, Silk Road Fund, SPARX Asia Capital Management and Tuspark Financial.

Intellectual property: Orrick is one of the most active law firms repre­senting local and foreign companies in sensitive patent and IP matters in China, Japan and the US. The team has in-depth experience litigating patents in wireless communications, integrated circuit design, digital TV, semiconductor and liquid crystal display, among numerous other technologies. Lawyers have secured a string of wins before the ITC in Section 337 matters and before district and appellate courts throughout the US. Since 2013, Orrick's China IP team has been selected by MOFCOM as a 'preferred US firm' to represent Chinese companies before the US ITC for patent infringement litigation. Tokyo-based IP lawyers also handle complex disputes in Japanese courts, involving patents, copyrights and trademarks, as well as unfair competition and trade secret actions.

Energy & Infrastructure: Orrick has decades of experience advising on complex cross-border energy and infrastructure projects in the power, petrochemical, oil and gas, transportation and mining sectors throughout Asia. The team plays an active role in the reinvigoration of Japan's green sector. Japan's Ministry of Economy, Trade and Industry turned to Orrick for structuring Japan's feed-in tariff policy, designed to accelerate investment in renewable energy. Since 2013, Orrick has acted for Setouchi Future Creation, a special-purpose company consisting of GE Energy Financial Services, Toyo Engineering and Kuni Umi Asset Management, as sponsor of the 231.44MW Setouchi Solar Project, which will be the largest of its kind in Japan when it launches in 2019.

Technology company representations: Orrick advises Asian technology companies at all stages of growth on a wide range of legal and strategic matters, including corporate formation and structure, financing activities, employment law, IP, data privacy, and exit and other strategic transactions. Clients include Acer, Ascent Robot­ics, Advanced Semiconductor Engineering, Baidu, Heka Bio, Microsoft, Tencent and Whill. Orrick also advises venture capital funds as well as CVCs in cross-border investments involving new technologies.

Real Estate Finance: Orrick advises global investors on cross-border joint ventures, acquisitions of real estate assets, property developments and complex financing transactions in Japan. The team also helps Japanese real estate investors in all phases of real estate investments, financings, developments, fund formation, leasing and operations overseas.
