Position

Ira G. Rosenstein is a partner in Morgan Lewis's Labor and Employment Practice and co-chair of the Individual Employment Litigation and Arbitration subpractice. Mr. Rosenstein represents both large and small employers in traditional employment disputes involving claims of discrimination, wrongful discharge, violation of federal and state wage and hour laws, and Sarbanes-Oxley whistleblower claims. Mr. Rosenstein is particularly known for his longtime representation of clients within the financial services industry, and is nationally known for his experience trying cases before FINRA (formerly the NASD/NYSE) and the American Arbitration Association. He is regularly called upon to handle financial industry-specific claims based on Form U-5 defamation, expungement, deferred compensation programs, commission arrangements, and bonus or incentive pay. Mr. Rosenstein started his legal career specializing in ERISA litigation and maintains a diverse practice, ranging from claims brought under the NLRA and FLSA, and state law wage and hour class actions to disputes brought under Title VII and the New York State and City Human Rights Laws. Mr. Rosenstein also regularly provides counsel on employment and labor issues stemming from mergers and acquisitions and other corporate transactions, as well as general advice on executive compensation and the hiring or departures of senior executives or key employees. Mr. Rosenstein regularly counsels employers on New York wage and hour issues, including audits and preventive approaches for avoiding class action and other litigation under the FLSA and New York Labor Law. He is the longtime editor and author of the New York Chapter of BNA's Wage and Hour Laws and speaks regularly on the subject.
