Mark Ter Molen is a litigator, with a particular emphasis on product liability/mass tort and environmental matters, and environmental attorney who for more than 20 years has focused primarily on representing clients in federal and state product liability/toxic tort and environmental trials and appeals, including putative class actions, in complex products and environmental litigation, and in regulatory hearings and appeals conducted before state and federal agencies. He also provides general corporate counselling on environmental compliance issues and environmental concerns in the context of corporate transactions; supervises environmental remediations pursuant to various state and/or federal requirements; and conducts condemnation and property valuation actions. Mark is the co-chair of Mayer Brown’s Environmental Litigation group, which was recently named by Law 360 as one of the “Environmental Litigation Groups of the year” for 2011. Mark is also the former chair of Mayer Brown’s mass tort litigation group. Among other accolades, Mark has been selected as a Leading Lawyer in Environmental Law and Toxic Tort Defense Law by the Law Bulletin Publishing Company's Leading Lawyers Network; as an Illinois "Super Lawyer;" and is listed in Chambers USA’s “America's Leading Lawyers for Business” directory, the Legal 500 for litigation, and various other allegedly prestigious lawyer rating services. In 1996, Mark was honored with the Illinois State Bar Association’s John C. McAndrews Pro Bono Service Award for outstanding pro bono work in the state.

Mayer Brown’s ‘service is extremely good’. The team acts in high-stakes matters, such as air enforcement cases involving the CAA New Source Review program, criminal environmental prosecutions, and major development projects. It represented several industry groups in challenging the legality of the EPA’s new regulation defining the waters of the US. The team also defended CSX Transportation in several environmental tort lawsuits that alleged personal injuries and property damage resulting from the 2012 derailment of a Conrail train. The practice’s co-chairs are Chicago-based Richard Bulger, who acts for clients in the chemical, utility, scrap metal, railroad, and ranching industries, and Mark Ter Molen, whose experience includes toxic tort trials and appeals, as well as putative class actions.
