Position

As co-leader of the Construction and Engineering Professional Indemnity team, Sally Davies has extensive experience in the litigation, arbitration (domestic and international), mediation and adjudication of construction industry disputes. She advises owners, contractors, engineers and consultants, subcontractors and suppliers, as well as professionals and insurers, on all aspects of construction and engineering law. Sally is particularly experienced in dealing with construction-related insurance issues, including construction professional indemnity cases which involve large projects in the United Kingdom and around the world. She has resolved such disputes involving airports, sports stadia, harbour facilities, motorways, mines, roads, bridges, cranes and railways, dams, office facilities, distribution centres and water treatment facilities as well as traditional construction projects. Sally is a highly experienced litigator who has dealt with numerous multi-party construction cases. One of her most notable and successful cases, in which she defended chartered surveyors and valuers against claims of negligent valuation, proceeded to the House of Lords and is one of the leading cases on the law of damages. Her wide-ranging project involvement has given her considerable experience in resolving loss and expense claims, payment disputes in addition to claims involving issues of delay, disruption, prolongation and acceleration of works. Typifying such high professional regard, Sally has been elected a committee member of the Technology & Construction Solicitors Association (TeCSA).

Mayer Brown International LLP defends sensitive and high-profile professional negligence claims, often with an international element, for clients such as QBE, Kier, Beazley, AIG and Knight Frank. Jim Oulton is defending two BDO partners against allegations of negligence and dishonesty made in relation to the administration and sale of a hotel, and is defending HW Fisher & Company against allegations of negligence and breach of fiduciary duty, among others. Tom Duncan, who regularly handles construction-related professional indemnity claims, continues to advise Costain and its insurers on a number of issues which have arisen at three microbiological treatment plants and four IVC plants in Manchester, which are part of a £4bn waste-to-energy project; he is also advising Costain and its insurers on a case relating to paving at the Port of Felixstowe. The ‘unflappable and very commercial’ William Glassey is a ‘rare mix of technical legal knowledge, gravitas and practicality’; he heads the department with Michael Regan, who is noted for construction and engineering disputes alongside the ‘brilliantSally Davies. Sean Connolly handles disputes involving a range of accountancy, legal, investment banking, property management and design consultancy professionals, chartered surveyors, and insurance and reinsurance brokers; Jonathan Stone is active in construction and engineering disputes; and Matthew Williams, James Morris, and Hannah Cartwright are key senior associates. Lindsay McQuillian left the firm for an in-house role and Ingrid Hobbs joined Kennedys in 2018.
