Career

Within her relevant experience, it is worth highlighting her participation in the practice of individual labor hiring, advice on benefits and payroll applications, promotion in collective work agreements for termination of work contracts, advice on transfer of workers, parafiscal contributions, labor audits, liquidation of companies, consultancies in integral social security and occupational health, industrial security and immigration matters. She has also experience in management of labor disputes before the ordinary labor jurisdiction, handling of labor administrative procedures before the labor and immigration authorities and advice on the revision of agreements and conventions.

In terms of relevant experience in the topic of Restructuring Plans, Patricia has extensive experience in handling labor issues arising from commercial transactions, such as Mergers & Acquisitions, outsourcing of services, and liquidation of companies among others. Frequently, these procedures include the implementation of voluntary retirement plans or income modification plans, for which they have acquired enough knowledge and practice, which allows them to provide adequate support throughout the numerous processes.

On the issue of Immigration, she has provided comprehensive advice on the legal implications derived from the transfer of foreign employees to Colombia, or the departure of employees abroad. The foregoing, knowing the importance of the transfer of employees within multinational organizations in ​​human resources. In the same way, she is up to date in the different immigration procedures for the obtaining or renewal of visas or entry permits to the country, issued by the Colombian authorities.

Among her relevant international participations, she attended on behalf of the Labor and Immigration Group of Baker & Mckenzie of Bogotá, at the annual meeting of the "Global Migration and Executive Transfers Meeting" (GMET) which took place in November 2006 at the offices of Baker & McKenzie in New York, USA.

Likewise, she participated as technical advisor to the delegation of Colombian employers in the 93rd session of the International Labor Conference of the International Labor Organization that was held in June 2005 in Geneva, Switzerland.

Patricia was a candidate for Magistrate of the Supreme Court of Labor Court, replacing Dr. Carlos Isaac Nader. April 2007

Patricia has been a professor of labor law at the Faculty of Business Administration of the Universidad de los Andes and the Universidad Javeriana.

Acting principally for major Colombian and foreign companies, Gómez-Pinzón Abogados (GPA) handles litigation and social security-related matters as well as having experience in matters such as the structuring of employment agreements and compensation schemes. Led by senior associate Patricia Vergara, the four-strong department undertook the defence of Drypers Andina and Protisa Colombia in a suit brought by the family of a deceased employee, successfully reaching a compensation settlement and the clients’ full exoneration of any responsibility. Other 2018 mandates for the practice included organising the retirement plan of over 150 CODAD employees prior to the closing of its operations. Senior associate Mauricio Montealegre and associate Juan Sebastián Restrepo are also key names. Clients include Chemonics, Honeywell, Japan Tobacco International and PriceSmart.
