Position

Partner of the Firm and head of Dispute Resolution & Investment Protection Practice.

Career

For more than 10 years he was an Assistant Magistrate and Senior Officer in the Jurisdictional Branch. He was a senior associate in the Litigation Department of Baker & Mckenzie and a founding partner of Zuleta & Partners Legal Group, in which he was the Director of the Litigation Group.

He has been a guest lecturer on issues of national arbitration, national litigation and general evidentiary regime at the Universidad de los Andes and the Pontificia Universidad Javeriana de Cali, as well as in various events organized by the Chamber of Commerce of Bogotá.

Since 2012 he has been included as a "key lawyer" in Colombia in dispute resolution by Chambers & Partners and has been cataloged by the publication The Legal 500 as one of the "leading lawyers" in the Colombian legal market in the same practice area.

William has been an advisor to national and foreign companies for more than 25 years on complex commercial contracts, commercial distribution schemes, Colombian procedural law and, in general, on matters involving business law. As the attorney in charge of these companies, he has acted in countless processes before the ordinary jurisdiction and national arbitral tribunals in complex disputes. Within the group of foreign companies, he has provided specialized advice on issues of dispute resolution to four of the top ten companies that make up the Fortune 500 list for 2012, and twelve of the first hundred companies listed in the Global 500.

In Conflict Resolution, he has participated in more than 75 arbitrations conducted under the regulations of the Chamber of Commerce of Bogotá, Medellín and Pereira, whose accumulated pretensions are superior to 2.5 billion dollars.

In National Litigation, he has advised and represented companies in the pharmaceutical, consumer products, automotive and commerce sectors and industry in general, in matters that include popular actions, group actions, distribution claims, commercial agency, consumer's right and contractual and non-contractual liability actions.

Arbitration

Within: Arbitration

William Araque, who ‘stands out for his broad knowledge in arbitration’, leads the 16-strong team at Gómez-Pinzón Abogados (GPA), which acts for both private and state parties in national and international arbitration proceedings. Acting in conjunction with David Araque, he recently led the successful advice to IGT Games in arbitration proceedings involving state entity Coljuegos concerning an alleged breach of concession contract by IGT and the use of the "Baloto" brand. In other work, the team continues to represent Reficar in two arbitration procedures against EPC contractors and supervisors. Senior associate Natalia Castellanos is also noted.

Within: Litigation

The ‘results-oriented’ Gómez-Pinzón Abogados (GPA) is ‘outstanding in getting to know the business in order to give in-depth legal opinions, and not just providing off the book concepts and recommendations’. A very well-reputed figure in the field, William Araque heads the 16-strong team, with David Araque as co-director of the dispute resolution and investment protection practice. Both are particularly recommended for - among other skills - developing ‘relationships of trust generating a strong synergy’. The practice is continuing to act for Chevron on a $20m domestic litigation regarding the tariff that gas transporters or producers in Colombia may effectively charge purchasers. The case is particularly sensitive since it also involves the interpretation that the relevant regulatory body (Creg) has of the tariffs system. In other work, the team successfully represented Compañía Minera Cerro Tasajero, in the first and second instances, in a dispute arising out of a breach of a port-operation services contract. Clients include Honeywell, OHL, Refinería de Cartagena and Servientrega.
