Position

Joshua N. Holian is a partner in the San Francisco office of Latham & Watkins and a member of the firm's Litigation & Trial Department. He concentrates on federal and state antitrust and trade regulation issues. Mr. Holian represents clients across a range of industries in M&A transactions to secure the required antitrust clearances from US, European and other antitrust regulatory authorities. He also counsels clients on distribution, resale and pricing issues.

Latham & Watkins LLP’s US team, which includes global co-chairs Amanda Reeves and San Francisco-based Christopher Yates, is highly active in national and global cartel matters. A group including Marguerite Sullivan, New York-based Lawrence Buterman, Michael Egge and San Francisco-based Daniel Wall defended Sumitomo against global antitrust investigations and related civil litigation connected with alleged anti-competitive practices in the auto parts industry. Niall Lynch in San Francisco and New York-based Jeff Hammel are the lead advisers to Omnicom in the DOJ’s ongoing bid rigging grand jury investigation, which is part of a wider criminal antitrust investigation into the advertising agency market. In another matter, Lynch and associate Meaghan Thomas-Kennedy represented StarKist in an investigation into alleged price-fixing in the packaged tuna industry. In 2017, Joshua Holian transferred from the San Francisco office to the Brussels office. Christopher Campbell in San Francisco made partner, while Allyson Maltas was promoted to counsel.

Global co-chair Amanda Reeves, Michael Egge, counsel Farrell Malone and others are acting as global antitrust counsel to Agrium Inc in its $36bn merger of equals with Potash Corporation of Saskatchewan. In 2017, Reeves, Marcellus Williamson and counsel Alan Devlin were part of a cross-border team that assisted Integra LifeSciences with obtaining global clearances for its $1bn acquisition of Codman Neurosurgery from Johnson & Johnson.
