Position

Steve Benesh focuses his practice on business litigation and commercial disputes. He has represented clients in diverse matters, including patent and intellectual property, toxic tort and products liability, business torts, class actions, deceptive trade practices, fraud, breach of fiduciary duty, and breach of contract. Mr. Benesh has first chair jury and non-jury trial experience representing plaintiffs and defendants in state and federal courts, as well as arbitration and mediation experience.

Stephen Benesh at Bracewell LLP in Austin has ‘exceptional foresight, a focus on the details and a strong strategic view’. He represented Bank of New York Mellon Trust Company and Sandridge Mississippian Trusts in a securities class action alleging misrepresentation of the productive capacity of oil and gas fields. Stephen Crain and Bradley Benoit in Houston acted for Pier 1 Imports in a securities fraud class action filed in Texas and saw all claims dismissed.

Bracewell LLP’s Texas-based practice has been particularly active in front-end contract negotiation, with the real estate, petrochemicals, energy and infrastructure sectors among its busiest areas in 2017. Dallas-based Brian Mitchell represented the owner and developer of the Fairmont Convention Hotel in Austin in claims worth approximately $45m brought against the general contractor. Houston-based construction litigation co-chair Richard Whiteley represented NBC’s Houston affiliate in a construction dispute relating to water damage caused by a defective retaining wall as part of a $19m project for the design and build of a next generation broadcast facility. Group co-chair Phillip Sampson Jr, Aaron Roffwarg and Austin-based Stephen Benesh are the other key figures in the team. Attorneys are based in Houston, Texas, save where mentioned otherwise.
