Jonathan is a partner in the NHSLA team in Birmingham with 17 years’ experience in handling clinical negligence claims and 12 years NHSLA experience. Jonathan specialises in high end claims especially around neurological, obstetric and gynaecological matters. He also has experience of handling group litigation. 

Highlights this year include: 

  • Discontinuance in a claim concerning the management of rectal cancer where it was suggested that the Claimant should have been given long course rather than short course radiotherapy and criticism of the surgical technique used to resect the tumour. A discontinuance was secured 3 weeks before trial. 
  • Successful Defendant cost recovery following a four day trial in a claim concerning the nature and extent of a Claimant’s psychiatric injury.
  • Resolving a group of claims brought under the Human Rights Act for the wrongful retention of fetal material.

She also defended Royal Wolverhampton Hospital NHS Trust and NHS Resolution against a claim involving the delayed diagnosis of cauda equine syndrome. Sarah Manning  advised the Medical Protection Society on an orthopaedic hip surgery claim as well as National Health Service Litigation Authority and Royal Wolverhampton Hospitals NHS Trust on a cerebral palsy claim. Jonathan Fuggle  advised George Eliot Hospitals NHS Trust and NHS Resolution on a gynaecological procedure claim as well as Southend University Hospital NHS FT and NHS Resolution on a claim of mismanagement of rectal cancer. Neil Ward  defended Staffordshire and Stoke on Trent Partnership Trust & National Health Service Resolution against an alleged delay in diagnosing acute angle closure glaucoma. He similarly defended NHS Resolution / Southend University Hospital NHS Foundation Trust against a cerebral palsy medical negligence claim stemming from midwifery care. Simon Charlton has strong capabilities on mental health and governance matters. Other notable names include the recently promoted director Emma Rees , who has experience in birth, brain and spinal injury claims,  and solicitor David Toulmin van Sittert, who focuses on high-value traumatic injuries.
