Cerryg is a Partner and one of the UK’s best-known IP litigators, with more than 25 years' IP litigation experience.

Cerryg specialises in contentious IP involving trademarks, designs, copyright and confidential information. He is ranked as a leading trademark professional in World Trade Mark Review 1000, where he is described as “…having excellent judgment, always always thinks outside the box – not along tramlines – and inspires great loyalty in his team.” A top barrister also notes: “He seems to win more of his cases than anyone else.”

He is also ranked in 2018 by Managing Intellectual Property as an IP star for trademarks, ranked in Band 1 in Intellectual Property by Chambers and Partners, and by Legal 500 (Brand management, TMT).

Cerryg has been instructed on a number of the UK’s leading intellectual property cases, including the high profile “Glee” case, acting for Comic Enterprises Limited against 20th Century Fox Film Corporation, arising from the hit TV show Glee. This was one of the few cases to be given permission to Appeal to the Supreme Court.  Cerryg acted for Comic Enterprises who were successful before both the High Court and the Court of Appeal.

Cerryg has also been involved in number of seminal design cases, including acting for Dyson in the leading case on spare parts (Dyson v Qualtex). He has also been instructed on one of the very few reported cases on groundless threats actions involving eBay take down notices.  The reported cases Cerryg has worked on include by way of (limited) example:

Comic Enterprises Limited v 20th Century Fox Film Corporation; Cassie Creation Limited v Simon Blackmore and Mirrorkool Limited; Dyson v Vax; AS Watson BV & others v The Boots Company plc and others; Kingspan Group plc & another v Rockwool Limited; and Unilever plc v Griffin and BNP.

Over the past 12 months, the breadth of Cerryg’s practice is illustrated by the fact that he has been instructed by:

  • Honey Punch (a major US retailer) in a ground breaking invalidity claim against the UK owner of various registered UK and EU trade marks for “ever-greening”, which is the practice of artificially extending the life of trademarks by repeat refilings.
  • the Borough of Telford & Wrekin in a case against former employees for breach of confidence, database right and copyright infringement
  • Croydon County Council in its Defence of a copyright infringement claim brought by a videographer

Cerryg joined the IP team of Browne Jacobson in early 2017, from Gowling WLG where he was Head of Brands litigation.
