Litigation.
Position
Partner in Ogier Jersey’s litigation department. Has a broad commercial litigation and dispute resolution practice, with an emphasis on cross-border work, including: trust related contentious matters, often involving fraud and asset tracing; disputes arising out of the financial services industry including funds related investor/shareholder and disputes; insolvency and restructuring matters (including non-contentious company law applications); regulatory matters, particularly advising regulated business on investigations and enforcement actions as well as on anti-money laundering and proceeds of crime legislation and regulation; local property and construction disputes. Many Jersey trust matters are confidential and heard in private, but recent examples are cases acting for Vistra Trust Company (Jersey) Limited (multi-jurisdictional trust and fraud/asset tracing), RBC Trustees (CI) Limited (multi-jurisdictional litigation); Rawllnson & Hunter (trustee directions), Basel Trust Corporation (Channel Islands) Limited, HSBC Bank Plc (disputes concerning guarantee/security enforcement, construction/lease claims). G4S International Employment Services Limited. Recent reported cases: Jersey – Viken & Ors v New World Trust (Jersey) Limited (for New World Trust); in the Matter of the Bird Trusts (for Basel Trust Corporation (Jersey) Limited); Representation of BNP Paribas Jersey Trust Corporation Limited (for beneficiaries); Cayman Islands – Barclays Private Bank and Trust Company (Cayman) Limited v Chamberlain (for Barclays); TMSF v Wisteria Bay Limited and Utterton Limited (for the defendants).
